EXHIBIT B <br /> City Council: April 7, 1998 <br /> Conditions of Approval <br /> Case PUD-97-21 <br /> <br />Piannin~ <br /> <br />1. Development shall be substantially as shown on the development plan, design guidelines, <br /> tree report, and related materials, Exhibit "A", dated "Received" December 18, 1997, <br /> January 20, 1998, and February 12, 1998, on file with the Planning Department, except as <br /> modified by the following conditions. Minor changes to the plans may be allowed <br /> subject to the approval of the Planning Director if found to be in substantial conformance <br /> to the approved exhibits. <br /> <br />2. A final map creating Parcels "1", "2", and "3" of this PUD development plan shall not be <br /> recorded until such time that City sewer and water service is available for use by the new <br /> homes in this development. It shall be the determination of the Planning Director and <br /> City Engineer as to when these services are deemed available. <br /> <br />3. A final map creating Parcel "3" of this PUD development plan shall not be recorded until <br /> such time that the access to the parcel can be provided for by the new East-West Collector <br /> road identified in the North Sycamore Specific Plan. The temporary access easement to <br /> Parcel "3" shown on the PUD development plan is not approved and shall not be <br /> established or constructed. It shall be the determination of the Planning Director and City <br /> Engineer as to when the access to this parcel from the new street is available for use. <br /> <br />4. The cost allocations for the two new lots shall be paid to the funding developers at the <br /> time of recordation of the final map as part of the costs responsibilities of this parcel for <br /> the NSSP infrastructure improvements. The final pro-rata shares and costs shall be <br /> determined by the Planning Director and City Engineer. <br /> <br />5. This PUD development plan approval shall lapse and shall become void 2 years from the <br /> date the utility and roadway infrastructure necessary to serve the new lots is made <br /> available unless a final map has been approved and recorded. <br /> <br />6. The applicant shall obtain all building and other applicable City permits for the project <br /> prior to the commencement of construction. <br /> <br /> <br />
