Exhibit B: <br /> Conditions of Approval for PUD 96-14 <br /> Merritt Property <br /> City Council <br /> <br />Planning <br /> <br />1. Development shall be substantially as shown on the development plans, Exhibit A, <br /> dated "Received September 2, 1998" on file with the Planning Department, except <br /> as modified by the following conditions. Minor changes to the plans may be <br /> allowed subject to the approval of the Planning Director if found to be in <br /> substantial conformance to the approved exhibits. <br /> <br />2. This PUD shall be subject to the permitted and conditional uses oft. he R-I zoning <br /> district. <br /> <br />3. Approval of this PUD shall not take effect until the recording of the anney. ation <br /> map and description by LAFCO. <br /> <br />4. In the event the property tax-sharing agreement negotiated for the City dtmng the <br /> annexation of the project results in the city receiving less than the cmTent average <br /> share of property tax, the applicant shall work with the City to make up the <br /> shortfall on a permanent basis. <br /> <br />5. The existing manufacturing operations shall cease operation upon recordation of <br /> the annexation for this property. All hazardous materials used for this <br /> manufacturing process shall be removed from the site at this time in accordance <br /> with the applicable City and State Codes. The City Fire Marshall shall inspect the <br /> site to determine whether this has been completed and shall submit a report <br /> certifying that this has been completed to the Planning Director prior to the <br /> issuance of a building permit. <br /> <br /> 6. Prior to recordation of the final map, all modifications required to the design <br /> guidelines by these conditions of approval shall be combined into a single <br /> comprehensive document.
