Exhibit B: Conditions of Approval for PUD 96-14 Merritt Property City Council Planning 1. Development shall be substantially as shown on the development plans, Exhibit A, dated "Received September 2, 1998" on file with the Planning Department, except as modified by the following conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance to the approved exhibits. 2. In the event the property tax-sharing agreement negotiated for the City dtmng the annexation of the project results in the city receiving less than the cmTent average share of property tax, the applicant shall work with the City to make up the shortfall on a permanent basis. 5. The existing manufacturing operations shall cease operation upon recordation of the annexation for this property. All hazardous materials used for this manufacturing process shall be removed from the site at this time in accordance with the applicable City and State Codes. The City Fire Marshall shall inspect the site to determine whether this has been completed and shall submit a report certifying that this has been completed to the Planning Director prior to the issuance of a building permit. 6. Prior to recordation of the final map, all modifications required to the design guidelines by these conditions of approval shall be combined into a single comprehensive document.
