Based upon anticipated traffic volumes at build out, needed improvements are <br /> then catalogued. The costs are then estimated for each traffic improvement. <br /> That cost is then allocated between existing and new development, depending <br /> upon whether new or existing vehicle trips generate the need for the project. <br /> The City Council finds that such a calculation is reasonably based upon the <br /> projected numbers of peak hour trips of residents for each new residential <br /> unit, and employees for different types of commercial, office, and industrial <br /> uses derived from current traffic generation data, as well as current <br /> construction costs. <br /> <br /> F. While the City is committed and will continue to pursue all available sources <br /> of funds to construct the traffic improvements, it acknowledges that based <br /> upon the reasonable cost estimates, sufficient funding is not available absent <br /> the Traffic Development Fee to support the demand for traffic improvements <br /> generated by new development. <br /> <br />8. The traffic improvements which will be constructed with funds generated by the <br />Traffic Development Fee will significantly benefit the contributor by substantially <br />mitigating adverse impacts, such as: traffic congestion on streets and intersections, air <br />pollution, and noise. The inability or failure to reduce these adverse impacts caused by <br />insufficient traffic improvements will negatively impact all residents, businesses, and <br />employees in the City. <br /> <br /> 9. The City Council further finds that the Traffic Development Fee to be charged <br /> pursuant to this ordinance does not exceed the estimated reasonable costs of acquiring <br /> and constructing the traffic improvements cataloged in the Report. The City Council <br /> additionally finds that the method of allocation adopted by this ordinance which is based <br /> upon peak hour trips for categories of land uses assures that the applicable fee bears a fair <br /> and reasonable relationship to each such development's burden on, and benefit from, the <br /> proposed traffic improvements to be funded by this ordinance. <br /> <br /> <br />
