Ordinance No. 1772 <br />Page 8 <br /> <br /> (2) Building Permit. A person who applies for a building permit for new <br />commercial construction, for a new residential unit, or for a Substantial Remodel, within <br />the properties identified in Section 3.40.030 C of this Chapter shall pay to the City, upon <br />issuance of the permit, an Area Development Impact Fee in the amount set forth in the <br />Master Fee Schedule, unless the Area Development Impact Fee for that property has <br />already been paid. <br /> <br /> D. Fee Unit. The unit basis of the fee shall be: <br /> <br /> (1) Residential Fees. The Area Development Impact Fee for residential <br />construction shall be charged for each new lot share with a specific Area Development <br />Impact Fee amount set for each unit type referenced in this Chapter. <br /> <br /> (2) Fees for Nonresidential Uses. The Area Development Impact Fee for <br />nonresidential construction shall be charged on a per residential lot share equivalent basis. <br /> <br /> (3) Fees for Other Uses. Uses not specified in the Technical Report or <br />the Area Development Impact Fee resolution shall be calculated by the Planning Director <br />on the basis of the facility costs and allocation methods used for the specified uses on a <br />per residential lot share equivalent basis. <br /> <br /> E. Formula for Calculating the Fees. The Area Development Impact Fee shall <br />be determined by a formula that is based on the cost of the required infrastructure <br />facilities, the proportion of those costs attributable to development in the North Sycamore <br />Specific Plan Area and certain other areas as a whole, and each unit of development's <br />proportional share of the North Sycamore Specific Plan Area costs as a whole. These <br />formulas are included in the Technical Report, and shall be updated from time-to-time to <br />reflect changes in construction costs, the amount of actual development to the extent that <br />a development application provides for a different number of units than the number which <br />was the basis for the fee formulas, the actual proportional share of costs as determined by <br />additional engineering analysis, and other factors. <br /> <br />3.40.050 Use of Fee Revenue <br /> <br /> The Area Development Impact Fee shall fund public facilities identified in the <br />Basic Infrastructure Program that are attributable to the new development within the <br />Noah Sycamore Specific Plan Area and certain other areas as determined in the <br />Technical Report and any future additions and amendments to the said Report, all of <br />which are incorporated in the Chapter by this reference. <br /> <br /> <br />
