Ordinance No. 1772 <br />Page 7 <br /> <br />3.40.040 Area Development Impact Fee Requirement <br /> <br /> A. Type of Development Subject to Fee. The properties for which the Area <br />Development Impact Fee will be charged are: <br /> <br /> (1) Lower NSSP; <br /> (2) Upper NSSP: <br /> (2a) Upper NSSP/Drainage; <br /> (2b) Upper NSSP/No NSSP Drainage; <br /> (3) Lund Ranch; <br /> (4) Spotorno Property; <br /> (5) Golf Course: <br /> (5a) Golf Course Residential; <br /> (5b) Golf Course Clubhouse and Ancillary Facilities. <br /> <br /> B. Amount of the fee. The amounts and calculation of each Area <br />Development Impact Fee shall be established by resolution of the City Council and shall <br />be based upon the following considerations: <br /> <br /> (1) New development will pay only for the construction of those public <br />facilities where there is a reasonable relationship between the facilities funded and the <br />demands and needs generated by the new development. <br /> <br /> (2) Each type of new development shall contribute to the funding of the <br />needed facilities in proportion to the need for the facilities created by that type of <br />development. <br /> <br /> (3) The public facilities funded by the Area Development Impact Fee <br />and the calculations resulting in the Area Development Impact Fee amount are <br />documented in the Technical Report. <br /> <br /> C. Applications Requiring Payment of Fee. <br /> <br /> (1) Subdivision. A person who applies for a residential subdivision for <br />properties identified in Section 3.40.030 C of this Chapter shall pay to the City, prior to <br />the approval of the final map, an Area Development Impact Fee in the amount set forth in <br />the City's adopted Master Fee Schedule. <br /> <br /> <br />
