Ordinance No. 1758 <br />Page Two <br /> <br /> (1) The City has received testimonial information from other local <br /> jurisdictions that fortune-telling may be linked to increases in the <br /> crime rates in those areas in which they are located and in the <br /> surrounding areas. <br /> <br /> (2) The effect of fortune-telling establishments on sensitive land uses <br /> and the concentration of fortune-telling establishments may result in <br /> adverse impacts on commercial districts if such uses are located <br /> there. <br /> <br /> (3) The City needs additional time to gather and synthesize information <br /> to determine if fortune-telling establishments result in adverse <br /> secondary effects, and what those effects could be on adjacent <br /> residential, recreation, religious, educational, and other <br /> fortune-telling establishments. <br /> <br /> B. For the reasons set forth above, the approval of use permits, conditional use <br /> permits, variances, building permits or other applicable entitlements for <br /> fortune-telling uses result in the threat set forth above to the public peace, <br /> health, safety and welfare of its citizens. <br /> <br /> Section 2: The City Council further finds that a continued temporary moratorium on the <br /> processing and approving use permits, conditional use permits, variances, building <br /> permits or other applicable entitlements for the uses identified herein is necessary <br /> to protect the public health, safety and welfare. <br /> <br /> Section 3: This ordinance shall take effect upon adoption as an urgency measure for the <br /> immediate preservation of public health, safety and welfare. This ordinance shall <br /> be of no further force and effect ninety (90) days from the date of its adoption. <br /> <br /> Section 4: A summary of this ordinance shall be published once within fifteen (15) days after <br /> its adoption in "The Tri-Valley Herald," a newspaper of general circulation <br /> published in the City of Pleasanton, and the complete ordinance shall be posted for <br /> fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br /> adoption. <br /> <br /> <br />
