Ordinance No. 1758 Page Two (1) The City has received testimonial information from other local jurisdictions that fortune-telling may be linked to increases in the crime rates in those areas in which they are located and in the surrounding areas. (2) The effect of fortune-telling establishments on sensitive land uses and the concentration of fortune-telling establishments may result in adverse impacts on commercial districts if such uses are located there. (3) The City needs additional time to gather and synthesize information to determine if fortune-telling establishments result in adverse secondary effects, and what those effects could be on adjacent residential, recreation, religious, educational, and other fortune-telling establishments. B. For the reasons set forth above, the approval of use permits, conditional use permits, variances, building permits or other applicable entitlements for fortune-telling uses result in the threat set forth above to the public peace, health, safety and welfare of its citizens. Section 2: The City Council further finds that a continued temporary moratorium on the processing and approving use permits, conditional use permits, variances, building permits or other applicable entitlements for the uses identified herein is necessary to protect the public health, safety and welfare. Section 3: This ordinance shall take effect upon adoption as an urgency measure for the immediate preservation of public health, safety and welfare. This ordinance shall be of no further force and effect ninety (90) days from the date of its adoption. Section 4: A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Tri-Valley Herald," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
