~,,9~ CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1758 <br /> <br /> AN INTERIM ORDINANCE EXTENDING A MORATORIUM <br /> PROHIBITING THE PROCESSING AND APPROVING <br /> CONDITIONAL USE PERMITS OR OTHER ZONING <br /> ENTITLEMENTS FOR FORTUNE-TELLING, PSYCHICS, <br /> AND RELATED USES WHICH MAY CONFLICT WITH <br /> PROPOSED ZONING ORDINANCES AND ZONING MAP <br /> AMENDMENTS AND DECLARING THIS ORDINANCE TO <br /> BE AN URGENCY MEASURE NECESSARY FOR THE <br /> pRESERVATION OF PUBLIC PEACE, HEALTH AND <br /> SAFETY <br /> <br /> WHEREAS, on June 23, 1998, the City Council adopted a 45 day zoning moratorium <br /> prohibiting the processing or approving of zoning entitlements for fortune-telling, <br /> psychic, palmistry, augury and related uses C fortune-telling"); and <br /> <br /> WHEREAS, staff has been gathering information from over 20 other Bay Area and California <br /> cities regarding regulation of fortune-telling; and <br /> WHEREAS, a community meeting has been scheduled for Thursday, August 6, 1998, at 7:00 <br /> p.m. in the City Council Chambers to receive input and answer questions from <br /> members of the community; and <br /> <br /> WHEREAS, staff is also carrying out legal research regarding the City's ability to regulate First <br /> Amendment rights through zoning and business regulations; and <br /> <br /> WHEREAS, the City Council finds that staff needs additional time to study this matter and <br /> prepare the necessary recommendations. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: Pursuant to Government Code Section 65858, the City Council of the City of <br /> Pleasanton does hereby find as follows: <br /> <br /> A.
