In response to a question from Chairperson Roberts, Mr. Plucker advised that the approval would only
allow the Saturday construction hours for building A initially, and if there are no complaints, the
Planning Director could allow the construction hours to continue for subsequent phases as the
construction activity approaches the residential developments. He noted that a condition allows the
Planning Director to revoke or modify this approval if complaints are received.

PUBLIC HEARING WAS OPENED

George Clever of Pleasanton Hines Land, LLC, represented the applicant. He noted that they are asking
consideration for Saturday hours, stating that the two newest neighbors, Stoneridge Apartments and
Masses, have submitted letters of support, primarily because it will allow the construction of the project
to be completed sooner and have the disruption of construction confined to a shorter amount of time. He
noted that they are projecting to be done in May, if Saturday work is allowed, as opposed to July. He
noted that they have been in construction for over a month and have not had any issues come up with
any of the neighbors. He requested clarification of the term "heavy equipment" in sub-condition "d."
He noted that he would assume that they could use back-hoes, loaders, and small graders.

Commissioner Kameny suggested that the applicant talk to staff with regard to the definition of
equipment, noting that the purpose of the condition is not to disturb adjacent residents. Mr. Plucker
noted that he believes staff and the applicant are in general agreement.

PUBLIC HEARING WAS CLOSED

Commissioner Kameny noted that he has no problem with the application as presented and the staff
conditions.

Chairperson Roberts advised that she concurred with Commissioner Kameny, particularly since the
conditions require that the applicant will check in following the completion of each building.

A motion was made by Commissioner Kameny, seconded by Commissioner Roberts, approving
Case Z-99-245, subject to the conditions of approval as shown in Exhibit "B."

ROLLCALLVOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioner Kameny and Chairperson Roberts
None
Commissioners Kumaran and Sullivan
Commissioner Maas

Resolution No. PC-99-66 was entered and adopted as motioned.

PLANNING COMMISSION MINUTES 4 September 22, 1999
