PUBLIC HEARING WAS OPENED

No one spoke on this item.

PUBLIC HEARING WAS CLOSED

Commissioner Roberts asked if there was any objection to the signage on the delivery cars.
Commissioner Kameny responded that this was not a problem. He noted that the proposed use was a
conditional use for the shopping center and the tenant space was a logical location.

Commissioner Maas expressed concern for the safety of children that purchase ice cream at the Rite Aid
store, noting that the delivery drivers would be driving through the parking lot in front of the stores. She
suggested that a condition be added requiring the drivers to use the driveway on Valley closest to the
tenant space. She also suggested that the drivers be required to carry the pizzas out to their parked
vehicles. She advised that she has no problem with the hours of operation.

Commissioner Kameny advised that he concurs with Commission Maas.

Discussion ensued regarding the possibility of requiring drivers to use the access behind the center and
the impacts truck deliveries in this area may have on this route, as well as the noise this may create for
residents behind the center. The Commission also discussed other alternatives for the drivers to enter
and exit the center.

A motion was made by Commissioner Roberts, seconded by Commissioner Maas, making the
conditional use permit findings and approving Case UP-99-39 subject to the conditions of
approval, adding a condition that pizzas will be carried out to the delivery vehicles that are
parked in the parking lot area adjacent to Valley Avenue, and the delivery vehicles shall use the
driveway on Valley Avenue to enter and exit the parking lot.

ROLLCALLVOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Kameny, Maas, Roberts, and Sullivan, and Chairperson Kumaran
None
None
None

Resolution No. PC-99-55 was entered and adopted as motioned.

Z-99-135, Michael and Sharleen Laver
Application for design review approval to construct a second-story addition over the
garage of the existing home located at 6446 Arlington Drive.
