Chairperson Kumaran stated he feels if the applicant is here the item should be heard. Commissioner <br />Roberts stated that she believes it is important that a person objecting to the application be allowed to <br />speak and she noted that the request is for a continuance in due time. Commissioner Kameny stated he <br />concurred with Chairperson Kumaran to hear the item tonight. He noted that the letters state the <br />neighbors concerns and the Commission has the information provided in the staff report which discusses <br />the neighbors' concerns. He also noted that the applicant is present. Commissioner Maas noted that the <br />Commission has the option of continuing the item after testimony is given. Commission Sullivan <br />advised that he agreed with Commissioner Roberts, and he feels that there are some neighborhood issues <br />and he would like all sides to be heard. Chairperson Kumaran stated that he believes Commissioner <br />Maas' compromise is a good one. The Commission agreed to hear Item 6.b. this evening, given the <br />number of people who are in the audience for this item, and that a determination would be made after the <br />public hearing as to whether the item would be continued. <br /> <br />5. PUBLIC HEARINGS <br /> <br />AP-99-05, Landscaping Plan for the Keane Residence <br />(Appellants: Larry and Suzan Dingman) <br />Application of the Planning Director's approval of the modified landscaping plan for the <br />westerly property line of the residence located at 417 Sycamore Road. Zoning for the <br />property is R-l-10,000 (Single-Family Residential) District. <br /> <br />Continued indefinitely. <br /> <br />UP-99-39, Little Caesar's <br />Application for a conditional use permit to operate a take-out pizza restaurant with <br />delivery from the Gene's Fine Foods Shopping Center located at 2889 Hopyard Road. <br />Zoning for the property is C-N (Neighborhood Commercial) District. <br /> <br />Mr. Swift presented the staff report. He advised that staff is recommending approval of the conditional <br />use permit. <br /> <br />Commissioner Roberts asked if there has been a pizza delivery business in the shopping center before. <br />Commissioner Kameny noted that there was a Mama's Take Home and Bake business previously located <br />in the center. <br /> <br />Chairperson Kumaran inquired as to whether the deliveries occur at the rear of the building.
