recommending that no action be taken. There was consensus that no action be taken at
this time.

b. Update on SFWD Bernai Property Project.

In addition to the information provided regarding this item under Item 7.a., Mr. Swift
reported that San Francisco Water Department has filed an appeal of the Planning
Commission's decision to not certify the EIR. He noted that they then immediately began
work on the radionuclide study, which was basically the direction of the Planning
Commission. He noted that it was their intention to complete the study, and if the study
showed there was nothing but background radiation on the property, and no particular
radionuclides were found, they would then return to the Commission and ask the
Commission to review the issue of the EIR again. He advised that as of today's
information that is what the study will say. Mr. Swift reported that the City Council has
established certain dates for the review of the project, with the first hearing being on
September 14, and, therefore, San Francisco would like to return to the Planning
Commission on its next regularly scheduled meeting, which is September 8. Mr. Swift
noted that there are a number of other applications pending on September 8. He noted
that ifa subsequent special meeting was needed to hear the other projects scheduled for
September 8, the date that was discussed with Chairperson Kumaran by the City Attorney
was Monday, September 13. He noted that most of those items are for projects at the
west end of the Vineyard Corridor Specific Plan area.

Chairperson Kumaran noted that he would prefer not to hold special meetings, because of
his schedule. Commissioner Sullivan noted that he would not want to get into routinely
scheduling special meetings. Commissioners Maas and Roberts agreed to the special
meeting date.

MATTERS FOR COMMISSION'S REVIEW

a. Future Planning Calendar

Commissioner Sullivan asked that an item regarding the "in-lieu-tree-fee" be placed on a future
agenda. Mr. Swift advised that he would like to work with Commissioner Sullivan in preparing
something to bring to the Commission.

Chairperson Kumaran advised that it is his understanding that any person making comments at a
meeting can clearly provide corrections that they want reflected in their comments. He stated
that he sees no problem with admitting into the minutes the revisions to Mr. Hovingh's own
statement, but as far as he is concerned, the minutes reflect what took place at the meeting, and if
that needs to be verified, the only source for this would be the tape recording.

b. Actions of the City Council

There were none.

PLANNING COMMISSION MINUTES Page 25 August 25, 1999
