MATTERS INITIATED BY COMMISSION MEMBERS <br /> <br />a. Consideration of a resolution to comment on the construction of the elementar~ <br /> <br />school on the SFWD Bernal property. <br /> <br />Mr. Swirl noted that the Pleasanton Unified School District authorized additional testing <br />beyond the report that the Commission received. He advised that the writer of the report <br />recognized that some of the information in the report is not absolutely accurate with <br />respect to how long spray irrigation has taken place on the site, however he was aware of <br />that prior to reaching his conclusions and added the additional memorandum. He <br />reported that the School District has authorized the Kleinfelder firm to continue to <br />monitor as excavation and grading takes place, and they have authorized that certain <br />cores to be taken that would be sampled as well. He noted that as of the writing of the <br />report, Kleinfelder had not found anything beyond background levels on this particular <br />property. He advised that in talking today with the people doing the studies on the San <br />Francisco property, they have reached the same conclusions. He noted that the report on <br />the San Francisco property will be available on Monday. <br /> <br />In response to an inquiry from Commissioner Sullivan, Mr. Swirl advised that surface <br />testing was done on the school district property and those results are included in the <br />report, and the soil sample results are not yet known. Mr. Swirl reported that they will be <br />bringing in new material from off the site as fill, which will essentially cap the existing <br />soil on that property. <br /> <br />Mr. Swirl confirmed that San Francisco is using surface testing, and analyzing soil <br />samples. <br /> <br />Commissioner Sullivan requested that he receive information regarding the regulatory <br />requirements (protocols and procedures) for this type of testing and who is the <br />responsible regulatory body. He also asked if the City will do a peer review of San <br />Francisco's testing. Mr. Swirl advised that the City is doing a number of things. He <br />reported that the City was involved in the initial scoping to the point of insisting that they <br />include the State and County agencies that oversee this type of testing in the scoping <br />sessions. He advised that we asked our EIR consultant to use her subconsultant, <br />Baseline, who reviewed the earlier work on this aspect of the property, to review and <br />critique the report. He indicated that we have strongly urged and will probably insist that <br />San Francisco contact the State agencies involved in the scoping and to get responses <br />from them as to what they see in the report and the materials as presented. He reported <br />that the City will hire its own consultant to analyze other areas in the City that may be <br />under the City's control where sludge or other materials for the old sewage treatment may <br />have been placed. <br /> <br />Chairperson Kumaran noted that the intent in asking for this information was for the <br />Commission to determine if it wanted to take any action.
