Minutes of July 14, 1999 <br /> <br />The minutes of the July 14, 1999 meeting were approved with the following revision: Commissioner <br />Maas requested that Page 5, first sentence, be amended to reflect that the applicant should be <br />conditioned to encourage Pleasanton parents to use a certain route to access the school; however, it <br />would not be a solution. <br /> <br />4. REVISIONS AND OMISSIONS TO THE AGENDA <br /> <br />Mr. Swift stated that Item No. 6.d. will be continued to the August 11, 1999 meeting; Item No. 6.e. has <br />been withdrawn; and Item No. 6.f. will be continued to the August 11, 1999, meeting. <br /> <br />5. MATTERS CONTINUED FOR DECISION <br /> <br />There were none. <br /> <br />6. PUBLIC HEARINGS <br /> <br />ao <br /> <br />UP-98-28, Score! Learning Corp. <br />Application for a conditional use permit to operate a children's tutoring service located at <br />5425 Sunol Boulevard, Suite 11. Zoning for the property is C-N (Neighborhood <br />Commercial) District. <br /> <br />Mr. Swift referenced a staff report dated July 28, 1999, and highlighted key areas contained in the report <br />including background information, project description, land use, parking, and noise. In conclusion, <br />Mr. Swift noted that staff's recommendation is that the Commission make the finding that the proposed <br />tutoring service can be considered a conditionally permitted use in the C-N District, make the required <br />conditional use pemfit findings, and approve Case UP-99-28, subject to the recommended conditions of <br />approval shown in Exhibit "B." <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />The applicant expressed concurrence with staffs recommendation and the conditions listed in <br />Exhibit "B." <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Maas disclosed that she had visited the center and she was concerned with the noise <br />generated by a basketball being used on site. She noted that the basketball is a nerf basketball. Further, <br />she stated that the dance studio in the shopping center has had no noise complaints filed.
