19.

20.

StaffRecommendation: Staff is satisfied that the structure of the initial approvals
satisfactorily addresses these issues; review of specific plan's addressing
the precise issue, with City discretion, allows the City to adopt reasonable
requirements with full information available to it.

Schools

[ssue~

The plan should provide for possible additional schools and for use of school
funds if facilities are built before project build-out.

Proposed Project: Provides site for elementary school per Pleasanton Unified School
District Master Plan; abides by "flat fee" agreement or successor agreement.

Alternatives:

Accommodate additional school sites (see #12 above).
Utilize school fee equivalent, if not necessary for new school construction,
for school endowment (or other allowable school use) or for City youth
programs.

Discussion:

See #12 generally for discussion of reserving additional school sites.
Pleasanton Unified School District and San Francisco have reached
agreement on the "flat fee agreement" and are exploring mechanisms to
ensure each project unit contributes even though all planned facilities may
be built prior to project build-out (a likely occurrence if school facilities
are to be present when needed). Per SB 50, it is unclear how the City may
require certain school-related mitigations. Having San Francisco and the
Pleasanton Unified School District reach an agreement prior to City
approval of the project would be a desirable end.

Principles of Agreement: Specifies reserve for planned elementary school site; specifies
school fees to be paid "at same rate as other properties in Pleasanton."

Staff Recommendation: The school requirements should be modified as necessary to
meet SB 50 concerns, to reflect purchase of the elementary school site by
the Pleasanton Unified School District, and to reflect any Pleasanton
Unified School District-San Francisco agreement. Absent such an
agreement covering furore fees, the City should specify use of otherwise
contributed school fees for City youth programs.

Fire

Issue:

Development should not occur outside a five-minute response zone during any
interim period prior to construction of the fire station unless sprinklered.

Substantive Issues/Alternatives Page 22 June 9, 1999
