Chairperson Kumaran requested that Page 4, be amended to read, "Chairperson Kumaran noted he <br />abstained from voting at the previous heating because he was absent at the meeting when the public <br />hearing was first held ... He stated that he has now read all materials provided by staff on the project and <br />would not be in favor of reconsidering the application." <br /> <br />Chairperson Kumaran requested that Page 5, be amended to read, "Chairperson Kumaran noted that he <br />voted not to reconsider because a study would have been conducted to address areas of concern; <br />however, he noted that Commissioner Roberts' statements about the change in traffic patterns areas and <br />so on, he would be in favor of the alternative to include this area in the Downtown Special Plan." <br /> <br />Chairperson Kumaran requested that Page 9, last paragraph, be amended to read, "Chairperson Kumaran <br />disclosed..." <br /> <br />Chairperson Kumaran requested that Page 10, be amended to read, "He mentioned that it is customary <br />that all fines and penalties are paid in full prior to the hearing and should the public agency find the levy <br />erroneous, the money would be refunded. He was surprised the applicant had not paid the penalties in <br />this case." <br /> <br />On order of the Chairperson, the minutes of February 10, 1999, were approved as amended. <br /> <br />3. MEETING OPEN FOR ANY MEMBER OF THE AUDIENCE TO ADDRESS THE <br /> <br />PLANNING COMMISSION ON ANY ITEM WHICH IS NOT ALREADY ON THE <br /> <br />AGENDA <br /> <br />Robert Cordtz, 262 West Angela, inquired as to the status of the fencing on the adjoining properties to <br />the Altamont Commuter Express (ACE) station. Mr. Higgins responded that there is ongoing discussion <br />with the property owners relating to fencing. Further, Mr. Cordtz expressed concern with the extensive <br />amount of time taken to develop the Downtown Specific Plan. <br /> <br />4. REVISIONS AND OMISSIONS TO THE AGENDA <br /> <br />Mr. Iserson stated that Item No. 6D will be continued to a future meeting. <br /> <br />5_.
