various businesses in downtown Pleasanton with murals and noted that this is not a political sign, that <br />sign does not detract from the attractiveness of downtown Pleasanton, and does not effect the public's <br />health and safety. She would like the applicant to paint the entire building. <br /> <br />Commissioner Sullivan noted that in his opinion the sign is a billboard and noted he is not in support of <br />approving application. <br /> <br />Commissioner Cooper stated that he likes the mural, but expressed his hesitation with approving the <br />application due to inability to make the finding of a special circumstance and the applicant being denied <br />privileges. In conclusion, he stated he would not be in support of approving application. <br /> <br />Commissioner Kameny inquired as to whether this is in the Downtown Specific Plan area and what the <br />Downtown Specific Plan states in relation to murals. Further, he stated he had no problem with <br />approving project with the condition that the whole building will be painted and that the findings can be <br />made. <br /> <br />Chairperson Kumaran stated that typically he is not in favor of large displays, but this is an appropriate <br />location for this sign and it would not detract from what is there. He stated that he could make the <br />findings and would be in support of the application with the conditions outlined. <br /> <br />Discussion ensued relating to the findings, approving murals on a case-by-case basis, the number of <br />signs already in place on building, and the neighbor's view of mural. <br /> <br />A motion was made by Commissioner Sullivan, seconded by Commissioner Cooper, that the <br />variance findings could not be made based on no special circumstance and to deny Case V-99-002/ <br />Z-98-279. <br /> <br />ROLLCALLVOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Cooper, Sullivan and Roberts <br />Chairperson Kumaran and Commissioner Kameny <br />None <br />Commissioner Maas <br /> <br />The motion passed on a 3-2 vote. <br /> <br />Resolution No. PC-99-06 was entered and adopted as motioned. <br /> <br />Mr. Iserson noted that the applicant has 15 days to file an appeal with the City Council. <br /> <br />(Recess taken from 10:22 p.m. to 10:25 p.m.) <br /> <br />PLANNiNG COMMISSION MiNUTES Page 9 January 27, 1999 <br /> <br /> <br />
