On order of the Chairperson, the minutes of December 9, 1998, were approved as amended. <br /> <br />3. MEETING OPEN FOR ANY MEMBER OF THE AUDIENCE TO ADDRESS TItE <br /> <br />PLANNING COMMISSION ON ANY ITEM WHICH IS NOT ALREADY ON THE <br />AGENDA <br /> <br /> There were none. <br />4. REVISIONS AND OMISSIONS TO THE AGENDA <br /> <br />Mr. Iserson stated that Item No. 6.a. will be continued to the January 27, 1999, Planning Commission <br />meeting. <br /> <br />5. MATTERS CONTINUED FOR DECISION <br /> <br />There were none. <br /> <br />6. PUBLIC HEARINGS <br /> <br />Z-98-296/SPA-98-3, Red Bear, Inc. <br />Application for (1) design review approval to construct at 39-unit hotel at 807 Main Street, <br />and (2) for a Downtown Specific Plan Amendment to permit the construction of a <br />three-story building where two-stories is the limit. Zoning for the property is C-C (Central <br />Commercial/Downtown Revitalization District. <br /> <br />Continued to January 27, 1999. <br /> <br />UP-98-75, WalMart <br />Application for a conditional use permit to conduct the sale of firearms within the existing <br />retail store located at 4501 Rosewood Drive. Zoning for the property is PUD (Planned Unit <br />Development) I/C-O (Industrial/Commercial-Office) District. <br /> <br />Mr. Iserson referenced the staff report dated January 13, 1999, and highlighted key areas contained in <br />the report including background information, site description, display and storage, delivery, hours of <br />operation, land use, security, and city, state and federal codes. In conclusion, Mr. Iserson stated that <br />staffs recommendation is that the Planning Commission make the required use permit findings and <br />adopt a resolution approving Case UP-98-75, subject to the conditions listed in Exhibit "B." <br /> <br />Discussion ensued between the Commissioners and staff relating to safekeeping of ammunition, issues <br />relating to firearms being on display for the view of children, the 15-day waiting period mandated for <br />release of firearms after purchase, and the physical location of firearms within the store. <br /> <br />PLANNING COMMISSION MINUTES Page 2 January 13, 1999 <br /> <br /> <br />
