television aerials, antennas, and transmission towers be setback 1,000 feet from the 1-580 <br />and 1-680 freeway rights-of-way. <br /> <br />Mr. Pavan presented the staff report, noting that the code amendment was prompted by an <br />application to place a FM antenna on the Wyndham Garden Hotel. He provided clarification <br />regarding the proposed text amendment and advised that staffis recommending that the Planning <br />Commission recommend to the City Council approval of the Code amendment. <br /> <br />In response to an inquiry from Commissioner Roberts, Mr. Pavan clarified that the 300 foot <br />setback from sensitive land uses was not provided for in the original Code language. He further <br />noted that this is a minimum setback distance, but each application would be reviewed <br />individually and a greater setback could be required. <br /> <br />Commissioner Arkin expressed concern about the health issues surrounding a high powered FM <br />transmitter. He asked what type of analysis was done to determine that the installation ora high <br />power transmitter, which is much more high powered that a cell antenna, is appropriate. <br /> <br />Mr. Pavan advised the proposal before the Commission this evening is for the Code change and <br />that the application for the antenna is still pending. He noted that determinations regarding <br />safety v~uld made for each individual application. Mr. Pavan further advised that peer review <br />would be completed for each proposal. <br /> <br />Discussion ensued regarding the purpose and intent of the Code modifications and how antenna <br />heights will be controlled. Mr. Swift advised that the maximum height allowances are still <br />governed by regulations for various zoning districts and that this Code amendment is an attempt <br />to streamline the approval process. <br /> <br />Commissioner Arkin questioned whether the towers could be used for something else if the <br />antennas become obsolete. Mr. Swift responded that the approval is granted for the use. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mr. Franklin A. Dancy, LCC International Inc., 3497 Breakwater Court, Hayward, advised that <br />he concurs with staff's recommendation. <br /> <br />In response to an inquiry from Commissioner Arkin, Mr. Dancy stated that his company's <br />customers will be anyone that has the new three-band radios that will be coming out this fall in <br />the new cars, as well as anyone who purchases the new radio and retrofits it into an older car. He <br />noted tl~t they plan to provide coverage throughout the country. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Maas made a motion recommending approval of Case PRZ-5, subject to the <br />conditions in Exhibit "A.'
