4. REVISIONS AND OMISSIONS TO THE AGENDA <br /> <br />Mr. Pavan advised that Item 6.b., PRZ-5, XM Radio, Inc., and Item 6.f., PUDo00-01, Delco <br />Builders, are continued to the meeting of November 8. In response to an inquiry from <br />Commissioner Roberts, Mr. Pavan advised that the UAE power plant facility will be presented in <br />a work session on November 8. He also advised that UAE has requested that a special meeting <br />of the Planning Commission be scheduled during the week following the November g meeting in <br />order to facilitate their approval time frame to secure natural gas connections. The Planning <br />Commission agreed to discuss the scheduling of a special meeting later in the meeting. <br /> <br />5. MATTERS CONTINUED FOR DECISION <br /> <br />There were none. <br /> <br />6. Nearon Entemrises <br />Application for PUD design review approval to construct a two-story, 55,417-sqtmre-foot <br />addition to an existing office building on a 10.56-ncre site (Lot 23) located at 5725 W. <br />Las Positas Blvd. in the Hacienda Business Park. Zoning for the property is PUD <br />(Planned Unit Development)- I/C-O (Industrial/Commereial-Office) District. <br /> <br />Mr. Pavan presented the staff report, providing a history of the design approval for the Hewlett <br />Packard building site, noting that the purchaser of the building, Nearon Enterprises, is proposing <br />design changes to the proposed building expansion as well as the site. Mr. Pavan reported that <br />the City's design consultant, Larry Cannon, has completed a peer review of the proposal and that <br />his suggestions have been included in the design. He noted that the applicant has requested that <br />constru~on be allowed Monday through Saturday, g:00 a.m. to 5:00 p.m. StafFs condition of <br />al~mval would limit conslruction to Monday through Friday, 8:00 a.m. to 5:00 p.m., due to the <br />close proximity of the site to residential uses. He noted that the construction of the Archstone <br />Apartments on Owens Drive was allowed on Monday through Saturday and staff received no <br />complaints. He further noted that staff is suggesting that the Planning Commission discuss the <br />construction hours with the applicant and make a determination if the hours should be extended <br />to include Saturday. He advised that staff is also suggesting that if the Saturday hours are <br />permitted, the project be conditioned prohibiting the use of equipment that generates loud, sharp <br />noises on Saturday. He noted that the office building project next to Stoneridge Mall has a <br />similar condition and that this has been acceptable. <br /> <br />Mr. Pavan advised that the proposed project came within three points of achieving the Green <br />Building Council's LEED certification. He noted that the applicant is requesting that the <br />condition requiting Green Building conformance for each subsequent tenant improvement be <br />modified. Mr. Pavan noted that the existing building, as well as the expansion are included in <br />the Hacienda Business Park and City traffic models.
