He also advised that <br />the applicant has agreed with the recommended conditions of approval. <br /> <br />Mr. Cn'abstick provided information regarding the geotechuical issues of the site and the analysis <br />and review completed for the proposal. He also presented an overview of the conclusions and <br />recommendations of the geotechnical review. He noted that it was determined that this is a <br />buildable site. <br /> <br />Commissioner Kameny inquired as to the City's policy related to liability for development of a <br />site such as this. Ms. Seto advised that the City dues not assume any liability if the applicant <br />chooses to build in an area where there is some risk. <br /> <br />Discussion ensued regarding the geoteclmical studies and issues related to the site. <br /> <br />In response to a question from Commissioner Roberts, Mr. Pavan noted that a condition of <br />approval is included requiring that the tree trimming be supervised by an arborist, but that he <br />would need to review the condition to determine if the intent is that all subsequent trimming be <br />supervised. He further noted that it could be modified to require that. <br /> <br />Commissioner Roberts asked for clarification regarding the statement in the staffreport <br />r~gardi~g the visual analysis and the proposed location of the home as shown on the site and <br />grading plans. Mr. Pavan advised the visual analysis reflected a house that was located ten feet <br />farther north. He noted that the analysis shows a "worst case" situation. <br /> <br />Commissioner Kameny questioned whether moving the house farther south would require a <br />reclesign of the house. Mr. Pavan stated that moving the house to the south would require a <br />redesign of the guest bedroom and bathroom. <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />Oreg Murm of Design Tech Associates, represented the applicant. He noted that the site has <br />b~en th~ongh geotechnical/engineering analysis and visual analysis, they have worked with the <br />Homeowners Association, and the house has been through six or seven redesigns. He presented <br />a photo hom'd depicting the existing homes in the area, noting that many of these homes are not a <br />n~toral color and are more apparent than the proposed home. He stated that the home meets the <br />intent of the existing West Foothill Road Corridor Overlay District, even though the property is <br />~ot within the District. He advised that he concerned that moving the house to save the trimming <br />of one oak tree may impact grading and'other ~ees may be lost. <br /> <br />Thuyen Q. Nguyenphuc, 3173 Perivale Court, San Jose, stated that he is the architect for the <br />project. He provided a rendering of the plan previously reviewed by the Commission, noting <br />that the detached garage has been eliminated and is now a attached garage, the width of the <br />house has been reduced, and the size of the house has been reduced.
