suggested replacing this condition with a condition stating that the property owners will <br />install a drip irrigation with the landscaping tied to the five-acre park. <br /> <br />Condition #83: Mr. Costanzo noted that Crteenbriar is willing to work with a similar <br />condition, but this condition is too stringent. He suggested wording that would limit this <br />condition to the "first release per residential community" only, and the deletion of section <br />(3) of the condition which requires pre-sale open honses for each phase. <br /> <br />Condition #83b: Mr. Costanzo stated that he did not believe Greenbriar could comply <br />with this condition due to the liability and legal aspects. It was noted that the wording <br />states that "the developer is encouraged." <br /> <br />Condition #84: Mr. Costanzo asked that the "check lists" replace this condition. <br /> <br />Mr. Co~anzo noted that Greenbriar was generally in agreement with the conditions for the 4000, <br />5000, 6000, and 12,000-square-foot lot components. <br /> <br />Ms. M~yer asked that Condition #23 for the apartment component be modified to allow for one- <br />Ballon fill-in shrubs, and maintain the requirement for "major" shrubs to be five-gallon. She <br />noted that condition #24 requires that the landscaping be completed prior to occupancy and that <br />they will want to phase the landscaping and requested that they be allowed to work with staff on <br />this to develop a plan. <br /> <br />Commissioner Arkin asked that the workers in the office complex be given preference for rental <br />of the apartments. Ms. Meyer stated that they would definitely work toward this objective, as <br />long as no laws are violated. She noted that they would agree to the wording that preference be <br />"encouraged." <br /> <br />Mr. Rosenbaum noted that he is concerned with Condition #13 regarding phas'mg of the office <br />project. He stated that they cannot accommodate this condition as written because of financing. <br />He stated that he would prefer to construct Buildings A as the first phase with the entire <br />hardscape, loop road, parking for the loop road, the parking to support Buildings A, and full <br />frontage and freeway (Valley and 1-680) landscaping. He stated they would create the pads and <br />fence the other two building areas. <br /> <br />Mr. Ro~enbaum requested that Condition g40(a) be modified to allow construction to begin at <br />7:00 a.m. until 5:00 p.m., Monday through Saturday for buildings other than Buildings A. <br /> <br />Commissioner Sullivan referenced Condition #38e, noting that he would like to know the status <br />of the mdionuclide tests. Mr. Swift advised that this is staff's recommended condition. Mr. <br />Costanzo noted that they received a fax this aftemoon from the Department of Health Services <br />stating that the review of the report has been finalized and they are satisfied with it and that no <br />further action is needed.
