Resolution No. PC-2000-40 was entered and adopWxl recommending approval of the General <br />Plan araendment and the rezoning. <br /> <br />Resolution No. PC-2000-41 was entered and adopted recommending approval of the conditional <br />use permit and the design review. <br /> <br />Commissioner Kameny noted he would be abstaining from the discussion and voting on Item <br />No. 6.d. <br /> <br />do <br /> <br />PUD-9S-I-1M. Tract Man 7030 (Eauus Height) <br />Application of Dong Yu Real Estate to (1) modify a condition of approval for PUD-98-1 <br />to extend the approval of the development plan, and (2) to extend Tentative Trap map <br />7030 for one-year. The development plan is a six-lot custom home subdivision located <br />on the west side of Foothill Road at Equips Court. <br /> <br />Mr. Plucker referenced a staffreport dated June 28, 2000 and highlighted key areas contained in <br />the report including background information and project description. In conclusion, Mr. Plucker <br />noted that staff's recommendation is that the Commission deny Case PUD-98-1-1M and Tract <br />7030 and recommend to the City Council that staff be directed to take the necessary steps to <br />revert the six lots to acreage. <br /> <br />Discussion ensued relating to modifications for access to upper lots by applicants, whether there <br />are designs for homes, the "spirit" of the West Foothill Road Overlay District being met, <br />clarification in staffreport relating to geotechnical considerations, and geotechnical enncerns in <br />the area. <br /> <br />Mr. Pluoker noted that staffwill provide the Commission at a future date a number of projects <br />that do not have valid vesting maps. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Joe Call~han, Callahan Property Company, advised the Commission that DeSilva-Callahan has <br />completed acquisition of the right-of-way and is willing to provide the portion requested for <br />Dong Yu's improvements to the City at the time their map is recorded. He noted the applicants <br />have agreed to staff's recommendation to accept the West Foothill Overlay District guidelines <br />for the project with the exception of the two lots that are set back and clustering requirements <br />are not possible. Further, he stated that Dong Yu is willing to accept additional timelinos such as <br />the subdivision agreement being executed and bonded within 60 days of action by the <br />Commission amending the PUD and to return in 120 days with a revised development plan <br />reflecting the guidelines being proposed in the new overlay district, including a visual analysis. <br />He requested that the Commission extend the tentative map for six months with the developer <br />expeditiously returning with a modified plan and an architect's input including specific house <br />plans. He noted by applying the West Foothill Road Overlay District guidelines, this project <br />may be reduced to five lots. He commented on the applicant's plan to relocate gate to the fight- <br />of-way. He provided an overview of the improvements the applicant will be conducting <br />including the widening of the east side of Foothill Road, installation of a deceleration lane, <br /> <br />PLANNING COMMISSION MINUTES June 28, 2000 Page 12 <br /> <br /> <br />
