CNM) <br />Application to consider an amendment to Chapter 18.44 of the Pleasanton Municipal <br />Code (Commercial Distxict) to make birthing centers conditionally permitted uses in the <br />Central Commercial Districts. The applicants are also applying for a conditional use <br />permit to operate a birthing center at 4441 Railroad Avenues. Zoning for the property is <br />Central Commercial (C-C), Downtown Revitalization District. <br /> <br />Mr. Plucker referenced a staffreport dated June 14, 2000 and highlighted key areas contained in <br />the report including background information, site and project description, operation of the center, <br />and noise and parking issues. Mr. Plucker noted there will be an extra condition that the <br />conditional use permit is contingent on the rezoning action being approved. In conclusion, he <br />noted that staff's recommendation is that the Commission recommend approval of <br />Case PRZ-03/PCUP-14 to the City Council by recommending approval of Case PRZ-03 as <br />shown on Exhibit C, making the required Conditional Use Permit findings as listed in the staff <br />report; and approve Case PCUP-14 subject to the conditions listed in the attached Exhibit "B." <br /> <br />Discussion ensued relating to whether additional visitors to the birthing center can be limited, the <br />necessity of Condition No. 8, and whether pediatricians will visit the birthing center. <br />Mr. Plucker noted that in relation to Condition No. 8, staff was attempting to be pro-active on <br />issues that may be of concern to the Commission and the neighborhood. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Beah Jaber, Certified Nurse Midwife, noted that large numbers of family members are not <br />present at the csmter due to the mother and child being released within four to six hours of birth <br />and with the birthing center being an intimate setting. She noted that pediatricians visit every <br />child prior to the mother and child being discharged. In response to an inquiry by the <br />Commission, Ms. Jaber stated that the noise from the fire station and adjacent park have not had <br />an impact on the clients. <br /> <br />Dr. Howard Long, concerned citizen, requested that the Commission eliminate Conditions 3, 7, <br />and 8 and noted that in his medical practice, no occupancy problems or parking problems have <br />arisen. Further, Dr. Long stated that this business is a valuable asset to the community. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Discussion ensued relating to Condition Nos. 3, 7, and 8, providing a "loading area" in front of <br />the business, patients parking in the driveway for <br />situations, and conducting additional classes at the facility. <br /> <br />PUBLIC HEARING WAS REOPENED <br /> <br />Les Layer, property owner, commented on the alternative accessibility provision for the Uniform <br />Building Code relating to handicapH:~l ramps.
