Mr. McDonald noted that he agreed with Commissioner Sullivan and there would be a visual <br />impact from Foothill Road with relocating Lot 7. He reminded the Commission there were no <br />Interstate 580 visibility issues when this project was originally designed. He noted the applicant <br />preferred the presented design and he would prefer the project be approved with the landscaping <br />requirements as provided for in the original West Foothill Overlay District Guidelines for lots <br />with visibility. Mr. McDonald stated that the Commission could deny the application, make <br />requirements to Lot 7, and let the project proceed to the City Council. He stated that the <br />engineering of the project has been worked through with staff several times and the proposed <br />layout works best for this number of units. In conclusion, he noted he would rather have a denial <br />from the Commission rather than develop another plan. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Discussion ensued relating to allowing 50 percent stucco on the homes. Commissioner Sullivan <br />noted stucco on homes will create more visibility of homes. Commissioner Arkin noted he <br />would be in favor of natural materials being utilized on homes. Chairperson Roberts noted that <br />the Commission is in favor of the West Foothill Road Overlay District recommendations for no <br />stucco on homes. <br /> <br />Chairperson Roberts clarified that the EVA will be reviewed during the Tentative Map approval <br />process. <br /> <br />A motio~ was made by Chairperson Roberts, seconded by Commissioner Maas, that Case <br />PUD-99-03 be forwarded to the City Council with a recommendation for approval by <br />making the finding that the proposed PUD Prezoning and PUD Development Plan will not <br />have a significant environmental impaet and resolution be adopted recommending <br />approval of Exhibit "C,' the draft Initial Study/Negative Declaration for PUD-99-03. <br />Further, that Lot 7 be removed; that the final details of the EVA be resolved in conjunction <br />with the Tentative Map to allow time for the Fire Department and the applicant to reach a <br />consensus on the EVA; that Lots I through 6 contain open fencing to be addressed at the <br />design review level; that the $6500 tree removal fee be reconsidered if Trec No. 110 is given <br />a poor condition rating; that there be a 22-foot maximum height for homes; that there be <br />no stucco on homes as referenced in the West Foothill Road Corridor Overlay District <br />guidelines; the first sentence in Condition No. 27 be deleted; and that the development plan <br />approval be valid for three years.
