the East Bay_Regional Park District's master plan and subject to review and <br />approval of the City. The text of this easement shall be subject to the review and <br />approval of the City Attorney, Planning Director, and the East Bay Regional Park <br />District. As necessary, the East Bay Regional Park District shall grant to the City <br />a public storm drain easement through its parcel for extension of the storm drain <br />outfall to the swale in accordance with Conditions 10.d. and 22. <br /> <br />36. <br /> <br />37. <br /> <br />Prior to City Council approval of the Final Map, the developer shall annex all <br />portions of the site not dedicated to the East Bay Regional Park District to the <br />Geologic Hazard Abatement District (GHAD) already established for The Preserve <br />(the residential subdivision adjacent to the site on the south). The district shall <br />have sole and full responsibility for the inspection, repair and continual <br />maintenance of landslides, unstable slopes, drainage systems, catch basins, <br />siltation ponds, and other geologic hazards. The annexation of this district shall be <br />subject to the review and approval of the City Attorney and City Engineer. <br /> <br />The applicant shall record CC&Rs at the time of recordation of the Final Map <br />which shall create a property owners association to hold in common ownership and <br />maintain any remaining open space areas and the emergency vehicle access road. <br />The CC&Rs shall be subject to the review and approval of the City Attomey prior <br />to recordation of the final map. The property owners association shall be <br />responsible for the maintenance of the emergency vehicle access (former private <br />driveway for Panganiban), the wetband landscape area, the graded slope area <br />between the extension of Crosby Drive and the East Bay Regional Park District <br />parcel (as defined in Condition 34), and any other open space areas not part of a <br />private lot. The City shall be granted the rights and remedies of the association, <br />but not the obligation, to enforce the maintenance responsibilities of the property <br />owners association. <br /> <br />38. <br /> <br />39. <br /> <br />A conservation/scenic easement in favor of the City shall be recorded over all the <br />above-mentioned open space areas not included within a residential lot. The <br />easement shall revert to the East Bay Regional Park District should the City <br />abandon its interest. This easement shall indicate that no future development is <br />permitted within the open space area except in conformance with the East Bay <br />Regional Park District's master plan and subject to review and approval of the <br />City. The text of this easement shall be subject to the review and approval of the <br />City Attorney, Planning Director, and the East Bay Regional Park District. <br /> <br />The City shall grant an emergency vehicle access and maintenance access <br />easement over the existing water tank access road solely for the purposes <br /> <br /> <br />
