Resolution No. PC-99-01 <br />Page 4 <br /> <br /> Exhibit "B: <br /> Conditions of Approval <br />Case UP-98-75 <br />4501 Rosewood Drive/Wal-Mart <br />Firearm Sales <br />(January 13, 1999) <br /> <br />1. The proposed use shall conform substantially to the written narrative, site plan, floor plan, and <br /> photographs, Exhibit "A", dated Received November 10, 1998, on file with the Planning <br /> Department, except as modified by the following conditions. Minor changes to the plans <br /> may be allowed subject to the approval of the Planning Director if found to be in substantial <br /> conformance to the approved exhibits. <br /> <br />2. If the operation of the proposed use results in conflicts in regard to parking, noise, traffic, or <br /> other impacts, at the discretion of the Planning Director, this use permit may be submitted to <br /> the Planning Commission for further review at a public heating. If necessary, the <br /> Commission may modify or add conditions of approval to mitigate such impact, or may <br /> revoke the use permit. <br /> <br />3. The applicant shall comply with all City Municipal Code regulations, including City <br /> ordinances no. 1719 and 1738, and all state and federal regulations regarding firearm sales. <br /> The applicant shall not sell, lease, or otherwise transfer a firearm without also selling or <br /> otherwise providing with each firearm a trigger lock or other similar device that is designed <br /> to prevent the unintentional discharge of the firearm. <br /> <br />4. Within thirty (30) days of approval of this case, Case UP-98-75, applicant shall apply for a <br /> Police Department permit to sell firearms at 4501 Rosewood Drive. The applicant shall <br /> maintain this permit at all times while selling firearms. This use permit is void without such <br /> Police Department permit. <br /> <br />5. The applicant shall place a sign legible to customers on the firearm display case which states <br /> the following, "all firearms sold shall be provided with a trigger lock or similar device that is <br /> designed to prevent the unintentional discharge of the firearm as required by the Pleasanton <br /> Municipal Code, Section 6.64.060.C". <br /> <br />6. The applicant shall not sell handguns unless specifically approved by the Planning <br /> Commission as a modification to this use permit. <br /> <br />7. Deliveries of firearms shall not occur between sunset and sunrise. <br /> <br /> <br />
