AGREEMENT <br /> <br />ARTICLE I <br />DEFINITIONS <br /> <br /> Section 1 "Definitions". in addition-to the terms defined elsewhere in th. is <br />Amended Cooperative Fee Agreement, as used in this Amended Cooperative Fee A~eement. the <br />following terms shall have the meaning set forth below: <br /> <br /> Section 1.1 "Affordable Residemial Unit". "Affordable Residential Unit" shall <br />mean a Residential Unit for which a household comprised of those individuals or families with <br />income less than one hundred twenty, percent (120%) of the median family income for the <br />Primary Metropolitan Statistical Area, defined as Alameda and Contra Costa Counties for a <br />family of four persons, adjusted up or down for larger or smaller household sizes ("PMSA <br />Median"), would qualify, to rent or to purchase. The down payment and interest rate assumptions <br />in determining an Affordable Residential Unit shall be established by the City.. <br /> <br /> Section 1.2 "Assessable Space". "Assessable Space" shall mean all space <br />within a Planned Residential Unit which is assessable pursuant to Govemmem Code section <br />65995. <br /> <br />Section 1.3 "Board". "Board" shall mean the Board of Trustees of the District. <br /> <br />Section 1.4 "Effective Date". "Effective Date" shall mean June 5.2001. <br /> <br /> Section 1.5 "Growth Management Approval". "Growth Management <br />Approval" shall mean that procedure described in Chapter 17.36 (Growth Management Program) <br />of the Pleasanton Municipal Code, as that Chapter may be amended from time to time. or any <br />other City. adopted Growth Management Program or procedure, by which the City. determines the <br />number and the timing of construction of certain Residential Units. Growth Managemem <br />Approval shall include exemptions therefrom. <br /> <br /> Section 1.6 "Land Use Entitlement". "Land Use Entitlement" shall mean every <br />application for (i) a rezoning that would permit a planned unit development plan, (ii) a planned <br />unit development plan, (iii) a residential subdivision map, including a vesting tentative map, (iv) <br />a conditional use permit which would permit a Planned Residential Project or (v) a building <br />permit for any Residential Unit or Planned Residential Unit in a Planned Residential Project. <br /> <br /> Section 1.7 "Multiple-Family Residential Rental Unit". "Multiple-Family <br />Residential Rental Unit" shall mean any Residential Unit which is constructed for the purpose of <br />being rented and which could not, without City. approval, be converted to a Single-Family <br />Residential Unit and which is built at a density, of 17 dwelling units per acre or greater. <br /> <br /> Section 1.8 "Planned Residential Unit". "Planned Residential Unit" shall <br />mean all residential units within the area or areas set forth in Exhibit "A". <br /> <br />June 1,2001 <br /> <br /> <br />
