CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 01-090 <br /> <br />RESOLUTION CERTIFYING THE FINAL SUPPLEMENTAL <br />ENVIRONMENTAL IMPACT REPORT FOR OAK TREE FARM - <br />PHASE 3 (INCLUDING ADOPTION OF NEW REGULATIONS <br />REGARDING GEOTECHNICAL SETBACK LINE) <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton is considering an application fi.om the Currin Construction <br />Company to certify the final supplemental environmental impact report (FSE[R) <br />for the Oak Tree Farm - Phase 3 development plan (PUD-97-01) and to repeal the <br />existing prohibitions of the geotechnical setback line (commonly referred to as the <br />"Beflogar Line") that was established by the City Council and adopt new <br />mitigations regarding the area; and <br /> <br />the City of Pleasanton provided proper legal notice of the availability of the <br />Supplemental Environmental Impact Report ("SEIR") for Oak Tree Farm - Phase <br />3; and <br /> <br />the City of Pleasanton has accepted and responded to comments to the Draft SEIR <br />from public agencies having jurisdiction by law, persons having special expertise <br />with respect of any environmental impact involved, and other persons and <br />organizations having an interest in the project; and <br /> <br />the final SEIR has been prepared and contains the DRAFT SEIR, comments and <br />recommendations received on the Draft SEIR, and responses to points raised <br />regarding environmental issues in the review and consultation process; and <br /> <br />the City of Pleasanton has provided proper notice of completion of the Final SEIR <br />for the project; and <br /> <br />the Planning Commission held a noticed public hearing on July 29, 1998 to <br />receive public comments regarding the Draft SE[R, and also held a noticed public <br />hearing on June 13, 2001 to receive public comments on the Final SE[R and to <br />consider the completeness and adequacy of the Final SEIR; and <br /> <br />WHEREAS, the Planning Commission found the SEIR complete and adequate and 'so <br /> recommended to the City Council; and <br /> <br /> <br />
