Resolution No. PC-2000-67
Page 2

2. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or materially
injurious to the properties or improvements in the vicinity.

The proposed use has been in operation for mom than six months
and no complaints have been received from neighboring property
owners. Beside fuel for the forklift, no hazardous materials are
proposed for the site. Fire Department approval would be required
for the storage of any hazardous material. Building Department
permits would be required to extend the sanitary sewer line, to
pave the site, and to install perimeter fencing. The use, as
proposed, would comply with the Parking Ordinance.

The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance.

The proposed use would meet the applicable provisions of the
Zoning Ordinance, if it were allowed for a limited time period. As
conditioned, the use would meet the parking and the drive aisle
requirements, and the applicant would be required to obtain all
necessary City permits.

WHEREAS, the Planning Commission determined that the proposed use is appropriate
as an interim use and shall be allowed for a maximum of three years.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
PLEASANTON RESOLVES THE FOLLOWING:

Section 1.

Approves Case PCUP-15/PDR-96, the application of Reuben Borg for a
conditional use permit to allow the operation of a retail fence sales
business and design review approval to allow the outdoor storage of
fencing materials and company vehicles, to allow the installation of new
landscaping, and to allow miscellaneous site improvements located at
3878 Stanley Boulevard, subject to the conditions shown in Exhibit "B,"
attached hereto and made part of this ease by reference.

Section 2. This resolution shall become effective 15 days after its passage and
adoption unless appealed prior to that time.
