The proposed location of the conditional use and the conditions <br /> under which it would be operated or maintained will not be <br /> detrimental to the public health, safety, or welfare, or materially <br /> injurious to the properties or improvements in the vicinity. <br /> <br />The proposed use has been in operation for mom than six months <br />and no complaints have been received from neighboring property <br />owners. Beside fuel for the forklift, no hazardous materials are <br />proposed for the site. Fire Department approval would be required <br />for the storage of any hazardous material. Building Department <br />permits would be required to extend the sanitary sewer line, to <br />pave the site, and to install perimeter fencing. The use, as <br />proposed, would comply with the Parking Ordinance. <br /> <br />The proposed conditional use will comply with each of the <br />applicable provisions of the Zoning Ordinance. <br /> <br />The proposed use would meet the applicable provisions of the <br />Zoning Ordinance, if it were allowed for a limited time period. As <br />conditioned, the use would meet the parking and the drive aisle <br />requirements, and the applicant would be required to obtain all <br />necessary City permits. <br /> <br />WHEREAS, the Planning Commission determined that the proposed use is appropriate <br /> as an interim use and shall be allowed for a maximum of three years. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-15/PDR-96, the application of Reuben Borg for a <br />conditional use permit to allow the operation of a retail fence sales <br />business and design review approval to allow the outdoor storage of <br />fencing materials and company vehicles, to allow the installation of new <br />landscaping, and to allow miscellaneous site improvements located at <br />3878 Stanley Boulevard, subject to the conditions shown in Exhibit "B," <br />attached hereto and made part of this ease by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after its passage and <br /> adoption unless appealed prior to that time. <br /> <br /> <br />
