D. City and Developer wish to enter into a growth <br />management agreement in order to achieve the benefits of the <br />Project to City and its residents and in accordance with the <br />purposes of the Growth Management Program. Development of the <br />commercial uses within the Project is not subject to the Growth <br />Management Program, and may be developed at any time in <br />accordance with the Initial Project Approvals. <br /> <br /> E. The Growth Management Program contemplates variations <br />to the program in certain cases for developments authorized <br />pursuant to a development agreement. This Agreement, executed <br />in connection with a development agreement for the Project, <br />implements the provisions of the Growth Management Program with <br />variations, as allowed under the program, concerning the use <br />and loss of growth management approval. <br /> <br /> F. Under Section 17.36.040 of the Growth Management <br />Program, certain categories of units, including second units <br />approved in accordance with City zoning regulations, mobile <br />homes and/or living quarters located on school, public and <br />other institutional properties meeting certain requirements and <br />condominium conversions or units replacing existing units that <br />have been demolished or destroyed, are exempt from the <br />provisions of the Growth Management Program and, therefore, are <br />not subject to this Agreement. These exemptions would include <br />assisted living, congregate care, secondary units and other <br />specialized housing units. Only the 581 residential units <br />authorized by the Initial Project Approvals are subject to this <br />Agreement. <br /> <br /> NOW, THEREFORE, in consideration of the mutual promises <br />expressed herein, City and Developer hereby agree as follows: <br /> <br />1. GROWTH MAI~AGEMENT APPROVAL <br /> <br />A. Except as otherwise specifically provided in this <br /> Agreement, City hereby grants growth management <br /> approval to the Project for development, according to <br /> the following schedule: <br /> <br /> -2- <br />87~./00 <br /> <br /> <br />
