Box 520 <br />PI~ _m~, CA 94566 <br /> <br />SPACE A~V~ <br /> <br /> August ~, 2000 <br /> DRAFT <br /> <br />GROWTH MANAGEMENT AGREEMENT <br /> <br /> THIS GROWTH MANAGEMENT AGREEMENT (thc <br />"Agreement") is made ,2000 between the GHC BERNAL INVESTORS, <br />LLC ("Developer") and the CITY OF PLEASANTON, a municipal corporation <br />("City"). <br /> <br />RECITALS: <br /> <br /> A. Developer owns certain real property (the ,,subject <br />Property") located in the City of Pleasanton and within <br />unincorporated Alameda County, as described in Exhibit "A," <br />attached to this Agreement and made a part of it by reference. <br /> That portion of the Subject Property currently within <br />unincorporated Alameda County is proposed by the Parties to be <br />annexed to the City of Pleasanton. <br /> <br /> B. This Agreement is one element of various development <br />approvals granted by City (collectively the "Initial Project <br />Approvals") vesting in Developer the right to build on the <br />Subject Property up to 581 residential units, up to 755,000 <br />square feet of commercial space and various other improvements <br /> (collectively the "Project"). ,A portion of the residential <br />units shall be market rate housing and a portion shall be <br />affordable housing (as defined herein). <br /> <br /> C. In order to control the rate at which residential <br />growth occurs within the City of Pleasanton, City may enter <br />into growth management agreements with developers under Chapter <br />17.36 of the Pleasanton Municipal Code (hereinafter referred to <br />as the "Growth Management Program"). <br /> <br />8/4/00 <br /> <br />-1- <br /> <br /> <br />
