The report shall determine whether the nest is being used,
or another nest has been established.

a)

If the nest is being actively used during the period when development activities
are proposed to be conducted, then improvements in the vicinity of the nest
should seek to minimize disturbance and possible loss of the active nest during the
nesting time as follows:

i)

Measures to be used to minimize disturbance to an active nest should
include establishing a buffer area around the nesting site. Land
development activities (including grading and other construction
activities) and other land uses shall be restricted within the buffer. The
buffer area should extend 50 feet from the base of the trunk or 25 feet from
the drip line of the tree in which the nest is located, whichever is greater.

b)

If the nest is not being actively used immediately prior to, or during proposed
construction activity, then no additional mitigation is necessary.

76)

O.
