75) <br /> <br />b) <br /> <br />Conditions imposed on any required 1603 S~eambed Alteration Agreements shall <br />become conditions of applicable grading permits. <br /> <br />Red-Tailed Hawk Nest Survey. Prior to any grading in the Western Area south of the <br />dry channel, Property Owner shall prepare and submit a Red-Tailed Hawk Nest Report to <br />the Planning Director. The purpose of such report shall be to confirm the potential active <br />use of an existing red-tailed hawk nest within the large valley oak tree along the eastern <br />edge of Arroyo de la Laguna. The report shall determine whether the nest is being used, <br />or another nest has been established. <br /> <br />a) <br /> <br />If the nest is being actively used during the period when development activities <br />are proposed to be conducted, then improvements in the vicinity of the nest <br />should seek to minimize disturbance and possible loss of the active nest during the <br />nesting time as follows: <br /> <br />i) <br /> <br />Measures to be used to minimize disturbance to an active nest should <br />include establishing a buffer area around the nesting site. Land <br />development activities (including grading and other construction <br />activities) and other land uses shall be restricted within the buffer. The <br />buffer area should extend 50 feet from the base of the trunk or 25 feet from <br />the drip line of the tree in which the nest is located, whichever is greater. <br /> <br />b) <br /> <br />If the nest is not being actively used immediately prior to, or during proposed <br />construction activity, then no additional mitigation is necessary. <br /> <br />76) <br /> <br />O. AFFORDABLE HOUSING <br /> <br />Affordable Housing Opportunities. The Project shall provide 15% of its total units at <br />housing costs affordable to low- and very-low income households in a variety of rental <br />and for-sale housing types. <br /> <br />The location of below-market rate duet units may be changed at the time the <br />MVTM is reviewed for approval so long as the number remains the same and they <br />remain dispersed throughout the Project. <br /> <br />b) <br /> <br />The allocation of residential development potential, as provided for under a <br />Growth Management agreement, shall include an allocation of affordable housing <br /> <br />Conditioas of Approval Page 41 of 44 August 9, 2000 <br /> <br /> <br />
