47) <br /> <br />48) <br /> <br />b) <br /> <br />c) <br /> <br />Intemhange improvements shall be undertaken by the City or others from <br />Caltran's initial review through design and construction. The Property Owners <br />obligation shall solely be to fund the improvements done by others. <br /> <br />Funding shall occur at the earlier of(i) when actual work begins, or (ii) at the <br />close of escrow of the final home in the Project. In the event (i) occurs first, <br />funding shall be on an as-invoiced basis. In the event (ii) occurs first, funding <br />shall be in a lump sum payment. <br /> <br />Phasing of On-Site Street Improvements. On-site streets may be phased as the Project <br />develops, provided that streets will provide satisfactory access (generally at least two <br />street accesses; temporary connections/emergency vehicle access ways may be allowed, <br />subject to the approval of the City), will not generate traffic on a street greater than its <br />design capacity in the short-term, and will not create a LOS "E" or worse condition at an <br />intersection with Bemal Avenue. <br /> <br />The underpass at the Union Pacific Railroad (UPRR) shall be not be required to <br />be constructed and operational until the occupancy of the final unit in the Project. <br />Temporary at-grade access for emergency purposes may be allowed prior to <br />reaching this threshold if approved by the California Public Utilities Commission. <br />Property Owner agrees to commence obtaining approvals for the underpass no <br />later than the time a final map for the Eastern Parcel is recorded; construction <br />shall begin no later than when the 250~ building permit for detached, single- <br />family units issued unless Property Owner demonstrates that, despite its good <br />faith efforts, it has not been able to secure the required permits from the PUC and <br />UPRK <br /> <br />Right-of-Way Dedication, Easements, and Maintenance. Street rights-of-my as <br />shown in Exhibits 11-13_shall be dedicated to the City unless otherwise expressly agreed <br />to by the Property Owner and the City. In addition, public easements for utilities, <br />sidewalks, and other public purposes may be required outside street rights-of-way as <br />shown in Exhibits 11-13. These rights-of-way and easements shall be expressly shown <br />on all tentative maps for City review and approval and shall thereafter be incorporated <br />into Final Maps. <br /> <br />Upon satisfactory completion of these improvements, the City shall accept and <br />maintain them, except as described in this PUD or otherwise mutually agreed to at <br />a later time. <br /> <br />b) <br /> <br />Property Owner shall provide a warranty maintenance bond to the City pursuant <br />to City Ordinance upon acceptance of improvements. <br /> <br />c) <br /> <br />Except as expressly described elsewhere in this PUD, the City shall maintain <br />street lights, roads, and landscaped medians, including traffic circles/round- <br />abouts; the Property Owner or other approved private entity shall maintain planter <br /> <br />Conditions of Approval Page 25 of 44 August 9, 2000 <br /> <br /> <br />
