39) <br /> <br />40) <br /> <br />improvements in the vicinity of the nest shoul, d be coordinated with <br />representatives of the California Department of Fish and Game to minimize <br />disturbance and possible loss of the active nest during the nesting time. This <br />coordination should include establishment of a buffer area around the nesting site <br />within which land development activities (such as grading and other construction <br />activities) and land uses are restricted. The buffer area should extend 50 feet from <br />the base of the trunk or 25 feet from the drip line of the tree in which the nest is <br />located, whichever is greater. <br /> <br />Property Owner shall conduct a cultural resources survey within any areas directly <br />affected by proposed grading activity as described in Condition 41. Additional <br />cultural resource monitoring and mitigation strategies may be required, as further <br />described in Conditions 42 and 43. <br /> <br />Requirements for Grading Activities. The following provisions shall apply to all <br />grading activities within the Project, and shall be a condition of all grading permits issued <br />within the Project: <br /> <br />Property Owner shall provide assurance that all soils affected by grading will be <br />brought to a stable and erosion-resistant state in the event that the Project is <br />prematurely terminated. The guarantee for this assurance shall be in the form of a <br />performance bond in an mount equal to the construction bid price, which shall be <br />provided to City prior to issuance of a grading permit. <br /> <br />h) <br /> <br />Graded slopes shall be re-vegetated as soon as practicable to prevent or minimize <br />erosion; hydro-seeding shall be accomplished before September 15, and irrigated <br />with a temporary irrigation system to ensure vegetation is established prior to <br />October 15. <br /> <br />c) <br /> <br />Surface drainage systems shall direct drainage away from cut and fill slopes and, <br />to the extent practicable, into planned retention/detention basins located on-site. <br /> <br />d) <br /> <br />New contours shall be designed to naturally blend into existing contours. Grading <br />for proposed soundberms along 1-680 should result in naturally appearing <br />land forms. <br /> <br />Construction Management. All grading activities shall be completed under supervision <br />of the Project soils engineer, Project engineering geologist, or Project civil engineer, who <br />shall, upon completion, submit a declaration to the Director of Public Works that all work <br />was done in accordance with recommendations contained in all required pre-grading <br />reports as described in Condition 38 above. Additionally, the following on-site practices <br />shall be conducted during all grading activities: <br /> <br />Comprehensive traffic control measures shall be implemented, including <br />scheduling of major track trips, and deliveries shall avoid peak travel hours and <br />shall not conflict with major events at the Alameda County Fairgrounds (the <br /> <br />Conditions of Approval Page 19 of 44 August 9, 2000 <br /> <br /> <br />
