b. PUD Condition addresses mitigation for sites which may be discovered
durMg futu~ survey or monitoring activities and recommends they either be avoided
or appropriately mitigated through a Resource Recovery Plan that meets appropriate
professional, City and State standards. The purpose of the Plan is to guide the
gatherMg of a sufficient quantity and variety of data at identified sites. The Resource
Recovery Plan must be approved prior to any grading (or construction-related)
activities. For those areas set aside for later investigation, no construction may occur
until the investigation is completed. Should human remains or a burial site be
discovered, the Propen'y Owner will consult with the City and tribal representatives to
determine the appropriate disposition of findings. Compliance with PUD Condition
will ensure the integrity of any, as yet, undiscovered archaeological sites either
by aVoiding them, or identifying further mitigation in the Resource Recovery Plan.
Documentation of the findings will ensure they are recorded and handled in
accordance with established standards.

2. ~.ill!C~. Potential for future development of the Project area to disturb
identified sites or resources.

Me~sure M2. Assure the protection of important cultural resources during site
planning and development.

.~qili_qg: Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the significant environmental effect
identified in the Final EIR to a less than significant level.

Fa9~s in Su_~nort of Findim~: The impact will be avoided or reduced based on the
follOwing:

a. Grading and construction-related activities could have a potentially adverse
effect on the two known prehistoric sites. One of the two sites (located on Parcel 25)
is designated open space which, the FEIR points out, is compatible withpreservation
of cultural resources. For this site, "capping" is an effective mitigation strategy
because the site will remain undisturbed.

b. The PUD includes Cultural Resources policies that require known cultural
resources to be protected by avoidance or "capping"; preparation of a Resources
Recovery Plan for sites that will be disturbed; an intensive cultural resource survey to
identify the extent and depth of known cultural resource sites; avoidance of resources
near the Bernal bridge by designating the site as a neighborhood park; and "capping"
the resources in the southeast quadrant of the 1-6g0/Bernal interchange.

39
