PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2000-45 <br /> <br />RESOLUTION RECOMMENDING ADOPTION OF THE CEQA FINDINGS AND THE <br />STATEMENT OF OVERRIDING CONSIDERATIONS FOR THE BERNAL <br />PROPERTY SPECIFIC PLAN AND PREZONING, ANNEXATION, PUD PLANS, AND <br />RELATED ACTIONS <br /> <br />the City of Pleasanton is considering a Specific Plan, prezoning, annexation, <br />Planned Unit Development (PUD) Plans, Preannexation Development Agreement, <br />Growth Management Agreement, Affordable Homing Agreement, and other related <br />matters (collectively the "Project") affecting approximately 516 +/- acres on both <br />sides of 1-680, south of Bernal Avenue; and <br /> <br />the City of Pleasanton, acting as lead agency under CEQA, determined that an EIR <br />was required for the Project and referred a Notice of Intent to prepare an EIR to ail <br />affected/interested agencies, persons and groups; and <br /> <br />WHEREAS, the City of Pleasanton prepared a Draft EIR for the project which was published on <br /> June 16, 1997, and notice of preparation and availability was properly provided; and <br /> <br />the City of Pleasanton accepted and responded to comments to the Drat~ EIR, and <br />prepared a Final EIR for the Project with provided responses to the issues raised; <br />and <br /> <br />the City of Pleasanton provided Notice of Completion of the Final EIR, and <br />following public heating, certified the Final EIR on February 15, 2000 by <br />Resolution No. 00-013; and <br /> <br />the Planning Commission has held notice public heatings on July 12 and 26, and <br />August 2 and 9, 2000, to take public comments regarding GHC Bemal Investors <br />LLC's plan to develop Phase I of the Project (which consists of about 170 acres of <br />commercial, office, medium and high density residential, and parks and recreational <br />uses); and <br /> <br />at its noticed public hearing on August 9, 2000 the Planning Commission <br />considered the Project and examined the CEQA findings of significant <br />environmental impact and the statement of overriding considerations; and <br /> <br />during the course of the review of the Project and the GHC Bemal Investors LLC's <br />proposai, the Planning Commission determined, in accordance with Section 15096 <br />of the CEQA Guidelines, that no major changes are required to the Final EIR <br />because: (a) no substantiai changes are proposed in the Project; Co) there have been <br />no substantial changes with respect to the circumstances under which the Project is <br /> <br /> <br />
