A second unit is not considered to increase the density of the lot upon which it is <br />located. <br /> <br />18.104.020 Conditional use permit requirements. <br /> <br /> A conditional use permit shall be required for any second unit. All of thc <br />requirements of Chapter 18.124 shall apply hereto, except that Ion those properties which <br />meet one of the three criteria listed below, the Zoning AdminiStrator shall bold the public <br />hearing and make the required findings, as provided in Sections 18.124.060 and <br />18.124.070 of the Municipal Code unless the Zoning Administrator determines in his or <br />her sole discretion to refer the matter to the Planning Commission. <br /> <br /> Pr _operties For Which the Zoning A~Imini~trator <br /> Shall Hold the Public Hearing and Make ~¢ RenUired Findings <br />(as Provided in Sections 18.124.060 and 18.124.070 of the Pleasa~ton Municipal ~ode) <br /> <br /> 1. Properties zoned R-l-10,000, R-I-20,000, R-I-40,000, or RM; <br />2. Properties in Planned Unit Developments which follow.the ~s. e and/or design standards <br /> of the R-1-10,000, R-I-20,000, R-1-40,000, or RM zoning districts; or <br />3. Properties which are 10,000 square feet or greater in size, are in a Planned Unit <br /> Development, and follow use and design standards similar tO those of the R-1-10,000, <br /> R-I-20,000, R-140,000, or RM zoning district (as determined by the Zoning <br /> Administrator). <br /> <br />Decisions of the Zoning Administrator may be appealed t° the Planning Commission, and <br />decisions of the Planning Commission may be appealed to the City Council as provided <br />in Sections 18.124.090 of the Municipal Code. All second unils shall be publiclY noticed <br />as described in Section 18.124.040. <br /> <br />18.10~030 Conflicting regulations. <br /> <br /> When the site development regulations of this Chapter conflict with the regulations <br />for second units in an approved applicable Planned Unit DevelOPment or Specific Plan, <br />the regulations of the Planned Unit Development or Specific Plan shall apply if the <br />applicable Planned Unit Development or Specific Plan were valid prior to the adoption of <br />this Chapter. The regulations of this Chapter shall apply to second units in Planned Unit <br />Developments or Specific Plans valid prior to the adoption of this Chapter, when the <br />regulations of the Planned Unit Development or Specific Plan refer to Class I accessory <br />structure regulations, but do not specifically refer to second unit regulations. <br /> <br />Exhibit A.2/RZ-98-03 <br /> Page 2 <br /> <br /> <br />
