Resolution No. PC-2000-38 <br />Page 2 <br /> <br />The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br /> <br />Public and private schools are a common use in both commercial and <br />residential areas in Pleasanton. For the past eleven years, Carden West <br />has generally been a "good neighbor" to the surrounding tenants and <br />residences. Sufficient parking, adequate separation from the residential <br />neighborhoods, maintenance of noise levels, and safety and security <br />within the premises have been provided or conditioned. All streets around <br />the site are designed per City standards to provide safe ingress and egress <br />into and out of the site. Conditions have been included that would require <br />the applicants to mitigate any future nuisances as a result of the proposed <br />use. <br /> <br />The proposed conditional use will comply with each of the <br />applicable provisions of the zoning ordinance. <br /> <br />Chapter 18.124 of the Municipal Code (Conditional Uses) states that, <br />because of their unusual characteristics, conditional uses require special <br />consideration so that they may be located properly with respect to their <br />effects on surrounding properties. The proposed use with reasonable <br />conditions of approval can integrate the proposed school use without <br />detrimentally affecting the surrounding prope~ies or the City in general. <br /> <br />the Planning Commission determined that the proposed classrooms and <br />minimal increase in the total number of students enrolled at the school can <br />be accommodated without creating adverse impacts on the adjacent <br />properties or tenants, and is acceptable. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-10, the application of Carden West School for a <br />conditional use permit to operate a private preschool through grade 2 <br />school with approximately 92 studems locat~l at 4444 Black Avenue, <br />subject to the conditions shown in Exhibit "B," attached hereto and made <br />part of this case by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after its passage and <br /> adoption unless appealed prior to that time. <br /> <br /> <br />
