PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2000-37 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF SHIN N. WEI FOR A <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE PCUP-13 <br /> <br />Yv~HEREAS, <br /> <br />Shin N. Wei has applied for a conditional use permit to allow an <br />approximately 1,000-square-foot second unit to be established in an <br />approved guest home located at 6237 Detjen Court; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR/OS (Planned Unit Development - <br /> Low Density Residential and Open Space) District; and <br /> <br />WHEREAS, <br /> <br />at its duly noticed public hearing of June 28, 2000, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, a modification such as that proposed is categorically exempt from the <br /> requirements of the California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following fmdings: <br /> <br />The proposed location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purpose of the <br />district in which the site is located. <br /> <br />The request to establish a detached second unit conforms with the <br />objectives and purposes of the zoning ordinance, the proposed second unit <br />ordinance, and the standards and purposes of the PUD for The Preserve. <br />State law considers second units as a single-family use, as would the City's <br />new second unit ordinance. The proposal would maintain the existing <br />single-family character of the development. In addition, a reeonunended <br />condition of approval requires that either the primary residence or the <br />second unit be owner-occupied and that a maximum of two adults shall be <br />allowed to reside in the unit <br /> <br />The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br /> <br /> <br />
