The design of the subdivision and proposed improvements will not <br /> cause substantial environmental damage or substantially and <br /> avoidably injure fish or wildlife or their habitat. <br /> <br />No waterways mn through the property; however, one runs nearby <br />to the north on the East Bay Regional Park District property. The <br />landscaping proposed by the waterway shall be native and fire <br />resistant. An environmental report did indicate that the site may be <br />suitable territory for the Alameda County whipsnake. Thus, <br />mitigation measures to protect whipsnakes were required per the <br />PUD conditions of approval. <br /> <br />o <br /> <br />The design of the subdivision is not likely to cause serious public <br />health problems. <br /> <br />The proposed project, as conditioned, meets all of the applicable <br />City standards concerning public health, safety, and welfare, e.g., <br />vehicle access, geologic hazards, and flood hazards. All public <br />safety measures are addressed through the provisions of approval <br />of the development plan and the conditions of approval for the <br />tentative map. The geotechnical review has shown that the <br />proposed design of the street system will create a safe circulation <br />pattern. A geologic hazard abatement district will be created to <br />help ensure long-term maintenance and safety of slopes. <br /> <br />The design of the subdivision or its related improvements will not <br />conflict with easements, acquired by the public at large, for access <br />through or use of property within the proposed subdivision. <br /> <br />As conditioned with the PUD, the applicants shall provide an <br />access easement to the existing Lemoine residence, to Ann <br />Sorensen, and to the East Bay Regional Park District. <br /> <br />WHEREAS, the Planning Commission determined that the proposed tentative map is <br /> consistent with the approved PUD development plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case Tract 7176, the application of Mardel LLC for vesting <br />tentative map approval to subdivide one parcel totaling approximately <br />seven acres into 12 parcels for a single-family home development located <br />at 4456 Foothill Road; and (2) final design review approval of the <br />proposed single-family homes located at 4456 Foothill Road, subject to <br />the conditions shown in Exhibit "B," attached hereto and made part of this <br />case by reference. <br /> <br /> <br />
