any other public or private corporation, political subdivision, district or agency <br />or any person whatsoever to acquire, construct, operate or maintain, within the <br />City or any part thereof, any system or utility competitive with the Enterprise; <br />provided, ho~vever, that the City may, without violating the covenant set forth in <br />this section, annex to the City any territory served by any privately owned water <br />system or by any publicly owned water system that is not part of the Enterprise <br />and may, after such annexation permit such other water system to continue to serve <br />such territory; provided, ]urther, that if such other water system shall be acquired <br />by the City by purchase, condemnation or otherwise, such water system shall <br />thereupon become part of the Enterprise. <br /> S£CTIO~ 5.10. Collection o~ Chart, es. The City will have in effect at all <br /> times an ordinance or resolution requiring the owner of any premises located <br /> within or without the limits of the City and connected with the Enterprise to pay <br /> the fees, rates and charges applicable to such connection and for water, services <br /> and facilities furnished by the Enterprise. The City will not permit any part of <br /> the Enterprise, or any facility thereof, to be used, or taken advantage of, fxee of <br /> charge by any person, firm or corporation, or by any public agency (including <br /> the United States of America, the State of California and any public corporation, <br /> political subdivision, city, county, district or agency of any thereof), excepting <br /> only that the City may without charge use water furnished by the Enterprise for <br /> park irrigation, street cleaning, fire fighting, and testing, maintenance and repair <br /> of the Enterprise and for similar municipal purposes, subiect to the limitations of <br /> Section 5.14. <br /> The City shall have in effect at all times while any of the Bonds are out- <br /> standing an ordinance or resolution providing for such charges, for the billing <br /> thereof, for a due date and a delinquency date for each bill (which delinquaney <br /> date shall be not later than 45 days following such-due date), and for discontinu- <br /> ance of service in the event of failure to pay any bill subsequent ~o delinquency. In <br /> each case where any bill remains unpaid after such bill becomes delinquent the City <br /> shall disconnect the premises from the Enterprise after fifteen days' written notice <br /> of such delinquency to the person billed. The City covenants that said notice shall <br /> be given promptly after the date of each delinquency. <br /> S£CT~Ot~ 5.11. Payment o! Taxes, Etc. The City will pay and discharge, <br /> or cause to be paid and discharged, all taxes, assessments and other governmental <br /> charges which may hereafter be lawfully imposed upon the Enterprise or any part <br /> thereof or upon any Revenues, when the same shall become due. The City will duly <br /> observe and conform with all valid requirements of any governmental authority <br /> relative to the Enterprise or any part thereof. <br /> S£CT~O~ 5.12. Construction o! Improvements. The City will commence, <br /> and will continue to completion the acquisition and construction of the improve- <br /> ments to the Enterprise described in the measure set forth in Section 1.01, and <br /> <br /> <br />
