34 <br /> <br /> (I) a detailed statement for the preceding fiscal year showing the <br /> Revenues, all disbursements from the Revenues and all expenditures ap- <br /> plicable to the Enterprise, together with a detailed balance sheet reflecting <br /> the financial condition of the Enterprise, including the balances in all funds <br /> relating to the Enterprise held by the Director of Finance and the Fiscal Agent <br /> as of the beginning of such fiscal year and all deposits in and withdrawals from <br /> each such fund during such fiscal year and the balances in all such funds-~ <br /> of the end of such fiscai year, which statement and balance sheet shall be <br /> accompanied by a certificate or opinion in writing of an independent certified <br /> public accountant which shall include a statement as to the manner and <br /> extent to which the City has complied with the provisions of this Resolution <br /> as it relates to said Revenues, expenditures, funds and balance sheet; <br /> (2) a general statement showing the schedule of connection charges <br /> and rates charged for each class of water connection, as of the close of such <br /> fiscal year, and the gross revenues received during such fiscal year; <br /> (3) a general statement of the physical condition of the Enterprise; and <br /> (4) a statement as to all insurance carried by the City as of the end <br /> of such fiscal year, including a brief description of the amount and coverage <br /> of each insurance policy and the name of the insuring company. <br /> <br /> The City will prepare and cause to be published annually (at the expense of <br />the City as part of the maintenance and operation costs of the Enterprise) not <br />more than 120 days after the close of each fiscal year (commenci..ng with the fiscal <br />year ending June 3~), 1968) a summary statement showing the amount of the <br />Revenues and the disbursements from the Revenues, in reasonable detail, for the <br />preceding fiscal year, and a general statement of the financial and physical condition <br />of the Enterprise. <br /> The City will furnish a copy of such. summary statement to any Bondholder <br />upon request, and will furnish to .the Fiscal Agent such reasonable number of <br />copies thereof (not e:~ceeding 100 copies) as may be required by the Fiscal Agent <br />for distribution to investment bankers, security dealers and others interested in the: <br />Bonds and to the holders of Bonds requesting copies thereof. The Fiscal Agent <br />shall not be required to incur any nonreimbursable el~_.~ses in making such <br />distribution. <br /> SI~CTIO~ 5.08. Protection of Security and Rights o[ Bondholders. The City <br />will preserve and protect the security of the Bonds and the rights of the Bond- <br />holders, and will warrant and defend their rights against all claims and demands <br />of ail persons. From and after the sale and delivery of any of the Bonds by the <br />City, the Bonds and coupons appertaining thereto shall be incontestable by the <br />City. <br /> SECTmN 5.09. Against Competitive Facilities. The City will not acquire, <br />construct, operate or maintain, and will not within the scope of its powers permit <br /> <br /> <br />
