During said leave, an employee shall not accrue vacation or sick leave benefits or be eligible for <br /> holidays, nor shall such time be considered as service <br /> 13.2 Extended Medical Leave <br /> Any regular or probationary employee who is temporarily disabled from work due to a medical <br /> condition may, upon written request to the Department Head and the Personnel Director, be <br /> granted by the City Manager, a leave of absence without pay for a period not to exceed three (3) <br /> months beyond the exhaustion of any accrued sick and vacation leave. With a recommendation by <br /> the Department Head to and approval by the Personnel Director, the City Manager may extend the <br /> leave for up to an additional thirty (30) days. In unusual circumstances involving catastrophic <br /> illness, the City Manager may, upon the recommendation of the Department Head and Personnel <br /> Director, extend a leave of absence without pay up to but not exceeding one year from the date of <br /> disability. <br /> The term medical disability includes all temporary medical disabilities including pregnancy, <br /> childbirth and associated medical conditions. Except in instances involving catastrophic illness <br /> the total approved paid and unpaid time away from work because of medical disability prior to and <br /> after the birth of a child, shall not exceed one hundred twenty (120) days. An employee no longer <br /> disabled because of pregnancy, childbirth or associated medical conditions may apply for <br /> additional unpaid leave time for the care of the child under the provisions of Section 12.1 above. <br /> Such request for medical leave will be considered only upon provision of a physician's statement <br /> attesting to said disability. <br /> During extended medical leave, an employee shall not accrue vacation or sick leave benefits or be <br /> eligible for holidays, nor shall such time be considered as service time. <br /> Any employee returning from medical leave shall be required to provide a physician's release to <br /> return to duty. <br /> 13.3 Jury Leave <br /> Every employee of the City who is called or required to serve as ajuror shall be entitled to leave <br /> from his/her duties with the City during the period of such service or while necessarily being <br /> present in court as a result of such call. The employee shall be paid the difference between his/her <br /> full salary and any payment received by him/her, except travel pay, for such duty. <br /> 13.4 Leaves Resulting from Subpoena <br /> Leave of absence with pay shall be granted to a person while going to and from court and <br /> answering a subpoena as a witness. The employee shall be paid the difference between his/her full <br /> salary and any payment received by him/her, except travel pay, for such duty. <br /> 13.5 Military Leave <br /> Military leave shall be granted in accordance with the provisions of law. All employees entitled to <br /> military leave shall give the Appointing Authority an opportunity within the limits of military <br /> regulations to determine when such leave shall be taken. <br /> 13.6 Return from Leave <br /> Upon the expiration of a regularly approved leave, the employee shall be reinstated in the position <br /> held at the time the leave was grained. Failure on the part of an employee on leave to report <br /> promptly at its expiration shall be cause for discipline up to and including dismissal. <br /> - 10 - <br />
