12.2 Sick Leave Usage <br /> Sick leave with pay shall be granted to all probationary and permanent full time employees within <br /> the competitive service. Sick leave shall not be considered a right which an employee may use in <br /> his/her discretion but shall be allowed only as follows: <br /> (1) In cases of necessity and actual personal sickness or disability of the employee. <br /> (2) For medical and dental appointments of the employee, at the discretion of the immediate <br /> supervisor. <br /> (3) For the care of cr attendance upon the sickness or disability of members of his/her <br /> immediate family or for bereavement because of the death of a member of his/her immediate <br /> family. A maximum of forty (40) hours per year of sick leave may be used for this purpose. <br /> The immediate family shall consist of the spouse, children, parents, brothers, sisters, <br /> grandparents, or other individuals whose relationship to the employee is that of a dependent <br /> or near dependent. The Police Chief shall grant such leave and determine the amount <br /> thereof; provided, however, that the Personnel Officer shall first, where necessary, pass upon <br /> sufficiency of relationship. <br /> This provision does not apply if the family sickness or disability or the employee's <br /> bereavement occurs while the employee is on vacation leave. <br /> An employee eligible for temporary disability payments may use accumulated sick leave in order <br /> to maintain his/her regular income; provided, however, that the employee shall be allowed a credit <br /> against sick leave to the extent that temporary disability payments are retained by the City. <br /> In order to receive compensation while absent on sick leave the employee shall cause notification <br /> to his /her immediate supervisor or the Police Chief prior to the time set for beginning his/her daily <br /> duties. <br /> When an absence is more than two consecutive full or partial shifts, the employee may be required <br /> to file a physician's certificate or personal affidavit stating the cause of the absence; except, <br /> however, if the employee uses excessive sick leave and/or demonstrates a pattern of sick leave <br /> misuse, abuse, or falsification (i.e.. using sick leave in conjunction with days off, vacation, <br /> holidays, or otherwise the employee may be required to file the physician's statement or personal <br /> affidavit following an absence of a single work shift. <br /> 12.3 Catastrophic Leave <br /> Effective May 1, 1998, the Catastrophic Leave Policy attached as Exhibit A shall be extended to <br /> Association members. <br /> Section 13. Leave of Absence <br /> 13.1 General Leave <br /> Any regular or probationary employee may upon written request to the Department Head and the <br /> Personnel Director, be granted by the City Manager a leave of absence without pay, for a period <br /> not to exceed three (3) months. The written request must state the reasons for the leave. The <br /> Department Head may grant a regular or probationary employee a leave of absence without pay, <br /> for a period not to exceed one (1) calendar week. Said leaves shall be reported to the Personnel <br /> Director. <br /> -9- <br />
