(c) <br /> <br />(d) <br /> <br />(e) <br /> <br />(f) <br /> <br />(g) <br /> <br />(h) <br /> <br />estimate shall be made by a registered civil <br />engineer acceptable to the City, and shall <br />be in a form acceptable to the City. <br /> <br />In order for the City to proceed to utilize <br />the Municipal Improvement Act of 1913 and the <br />Improvement Bond Act of 1915, the total cost <br />of improvements to be constructed and/or <br />acquired by the proposed assessment district <br />cannot exceed 50$ of the total appraised <br />value of the land or lots within the proposed <br />district. <br /> <br />A tStle report regarding the property involved <br />shall be submitted for City review in order <br />that any phior liehs or any other clouds on <br />the title may be ascePtained. <br /> <br />In hillside areas, proof Of soil stability in <br />the area affected by the proposed district, <br />sufficient to satisfy the City Engineer, <br />shall be submitted. <br /> <br />In any area where use of the Municipal Improve- <br />ment Act of 1913 and the Improvement Bond <br />Act of 1915 is permitted, the City shall infor~ <br />each affected property owner, by letter, that <br />in the event of a default the City will pro- <br />ceed immediately to take the property through <br />court proceedings, and that the City will not <br />allow the affected property to go through a <br />"tax sale!~. <br /> <br />Each person, firm or corporation desiring to <br />apply for use of the Municipal Improvement <br />Act of 1913 and the Improvement Bond Act of <br />1915 shall, at the time such application is <br />submitted, pay to the City the amount of <br />$200.00 in order to pay for the cost of inves- <br />tigating the feasibility of such application. <br /> <br />Said fee of $200.00 will not be refundable, <br />regardless of whether or not said application <br />is approved. <br /> <br />Subsequent to the investigation of each appli- <br />cation for feasibility under the above condi- <br />tions, the staff shall submit a report and <br />recommendation to the City Council regarding <br />the results of said investigation. <br /> <br />Subsequent to review of said report, the City <br />Council shall make a final determination as <br />to the approval or disapproval of said appli- <br />cation. <br /> <br />DATED: March 17, 1969 <br />ATTEST: <br /> <br />~E~R~--~.
