CITY OF PLEASANTON <br /> <br /> COUI~Y OF ALAI~DA <br />STATE OF CALIFORNIA <br /> <br /> RESOLUTioN NO. 69,5~ <br /> <br />POLICY GOVERNING THE ESTABLISNMENT OF SPECIAL ASSESSMENT <br />DISTRICTS UNDER THE MUNICIPAL IMPROVEMENT ACT OF 1913 <br />AND TI~ IMPROVEMENT BOND ACT OF 1915 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />NOW, <br /> <br />The CitY of Pleasanton has received requests for the <br />installation of public improvements and/or public <br />acquisi$1~n of improvements under the provisions of <br />the Municipal improvement Act of 1913 and the Improve- <br />ment Bond Act of 1915 of the State of California; and <br /> <br />There iS a need for a policy statement of this City <br />Council concerning the use Of the Municipal Improvement <br />Act of 1913 and the Improvement Bond Act of 1915 and <br />assessment districts within the City of Pleasanton; <br /> <br />THEREFORE, BE IT RESOLVED by the City Council of the City <br /> of Pleasanton that said policy governing the use of <br /> the Municipal Improvement Act of 1913 and the Improve- <br /> ment Bond Act of 1915 and assessment districts shall <br /> be as follows: <br /> <br />Whenever any person, firm or eorporatlon is desirous of <br />using the Municipal Improvement Act of 1913 and the <br />Improvement Bond Act of 1915 for the purpose of install- <br />ing public improvements and/or public acquisition of <br />improvements, said person, firm or corporation shall <br />first address a written request to the City Council <br />requesting permission to use said Acts. Said written <br />request shall describe the public improvements to be <br />installed and/or acquired, and shall set forth the <br />reasons why the applicant feels the use of said Acts <br />will be of over-all benefit to the City and, therefore, <br />will be in the general public interest. <br /> <br />Upon receiving said request, the City Council shall <br />review said request and shall make a specific determina- <br />tion as to whether or not the use of the Municipal Improve- <br />ment Act of 1913 and the Improvement Bond Act of 1915 <br />will be of over-all benefit to the City and, therefore, <br />will be in the general public interest. <br /> <br /> Only in the event that the City Council determines <br /> that the use of said Acts will be of over-all benefit <br /> to the City and, therefore, in the general public <br /> interest, the following conditions will he applied <br /> to said request. Each request for the use of said <br /> Acts must meet all of the following conditions in <br /> order to qualify for the use of said Acts: <br /> <br /> (a) An appraisal of the property involved, in an <br /> unimproved and improved condition, shall be <br /> submitted for City review. Said appraisal <br /> shall be made by a qualified appraiser <br /> acceptable to the City, and shall be in a <br /> form acceptable to the City. <br /> <br />(b) <br /> <br />An engineer's cost estimate of the improve- <br />ments to be constructed and/or acquired by <br />and under the proposed assessment district <br />shall be submitted for City ~eview.
