WHEREAS, on the 13th day of July, 1970, said hearing was held and there were no protests against said improvements or said proceedings by any person; and WHEREAS, on the 13th day of July, 1970, the City Council of the City of Pleasanton directed the Engineer of Work to file an Amended Engineer's Report; and WHEREAS, on the 13th day of July, 1970, the Engineer of Work filed 'i~with the City Clerk of the City of Pleasanton an Amended Engineer's iReport; ~OW, THEREFORE, BE IT RESOLVED by the City Council o£ the City'of Pleasanton, Alameda County, California, that this Council does hereby find, determine and order as follows: 1. That no one, at or prior to the time fixed for said hearing, filed a written protest against said proposed improvements as a whole, or against said district, or the extent thereof to be assessed for the costs and expenses of said improvements, or as to the estimate of costs and expenses thereof; that no person appeared at the time fixed for said hearing to make, nor did any person make, any oral objection or protest against any of the above matters, or the improvements; that no one appeared or protested or made any objection to the Engineer's Report or said improve- ment proceedings at any time. 2. That the district benefited by said improvements, and to be assessed to pay the costs and expenses thereof, is more particularly described in the Resolution of Intention hereinabove referred to and made a part hereof by reference thereto. That all public streets and highways within said assessment district, the same being in use in the performance of a public function as such, shall be omitted from said district and from. the levy and collection of the special assessments to be hereafter levied and collected to cover the costs and expenses of said improvements.
