If, on or before July 1, 1971, said special assessment district has not been formed by City, or Electric Company has not completed the trenching work to be performed by it, this agreement shall forthwith terminate and neither City nor Telephone Company shall.'hav~__any further obligation hereunder· 5.~ Upon completion of the installation of said under- ground communications distribution system as provided herein, Telephone Company shall from time to time thereafter perform other ~work~necessary to furnish communications service to its customers and applicants for service along the route of said system by means of said system subject to the conditions tkat, in accordance with Telephone Company's tariffs, rules and regulations on file with the Public Utilities Commission of the State of California, (a) the customer or 4applicant furnishes, installs and maintains at his expense on the p~operty to be served the required underground supporting ~ structure in accordance with Telephone Company's specifications, and (b) such customers and applicants pay any applicable charge in so furnishing such service. 6. Title in and to said underground communications distri- bution system shall vest in Telephone Company pursuant to Section 10111 of the California Streets and Highways Code. 7. Upon completion of the installation of said underground communications distribution system City, upon receipt of Telephone Company's bill therefor, shall pay to Telephone Company the sum of one thousand three hundred dollars ($1,300) as the difference between the estimated cost to TeleRhone Company. of providing underground facilities and the estimated cost of constructing equivalent aerial facilities. _ ~.
