the Streets and Highways Cods of the State of California and the <br />parties hereto desire to enter into an agreement pursuant to <br />Section 10110 of said Streets and Highways Code; ............. <br /> <br /> NOW, THEREFORE, the parties hereto mutually agree as. <br /> <br />follows: <br /> <br /> 1. The term "underground supporting structure" includes <br /> the conduit, manholes, handholes and pull boxes where and as <br /> <br />.required, plus trenching costs. The term "trenching costs" means <br /> and includes the cost of excavating, backfilling and compacting, <br /> and, where necessary, the cost of breaking and repaving pavement and <br /> of restoring landscaping. <br /> <br /> 2. After said special assessment proceedings have been <br /> taken and upon completion of trenching work to be performed by <br /> Pacific. Gas and Electric Company, hereinafter called "Electric <br /> ComPany", in conjunction with the performance of certain work on <br /> <br />Electric Company's facilities contemplated by a separate agreement <br />_between City and E!ectri'c~Company, TeLephone Company shall install, <br /> <br /> in the locations shown on the drawing attached hereto marked Exhibit <br /> A a~d hereby made a part hereof, the underground communications dis- <br /> tribution system necessary for said underground telephone facilities. <br /> <br /> 3. Telephone Company shall not be responsible for any <br /> delay resulting from shortage of labor or materials, strikes, labor <br /> disturbances, war,' riots, weather conditions, governmental rules, <br /> regulations or orders, including orders or judgments of any court, <br /> acts of God, or any other cause or condition of like or unlike <br /> characteristic which is .beyond the control of Telephone Company. <br /> Telephone Company shall have the right, in the event it is unable to <br /> obtain supplies', materials or labor for all of its construction re- <br /> <br /> quirements, to allocate materials and labor to construction projects <br /> which, in its sole discretion, it deems most important to serve the <br /> needs of its subscribers; and any delay in performance of work here- <br /> under resulting from such allocation shall be deemed a cause beyond <br /> Telephone Company's control. <br /> <br /> <br />
