Resolution No. 00-111 <br />Page Two <br /> <br />WHEREAS, <br /> <br />on August 9, 2000, the Planning Cotmnission recommended to the City Council <br />the approval of the Project, including the adoption of findings and a statement of <br />overriding considerations for the environmental review of the Project; and <br /> <br />WHEREAS, <br /> <br />the City Council held a noticed public hearing on August 21, 2000 to consider the <br />Project, and examine the CEQA findings of significant enviromnental impact, the <br />statement of overriding considerations: and <br /> <br />WHEREAS, <br /> <br />during the course of the review of the Project and the GHC Bemal Investors LLC's <br />proposal, the City Council, acting as lead agency under CEQA, has determined, in <br />accordance with Section 15096 of the CEQA Guidelines, that no major changes <br />are required to the Final EIR because: (a) no substantial changes are proposed in <br />the Project; (b) there have been no substantial changes with respect to the <br />cimumstances under which the Project is being undertaken; and (c) no new <br />information of substantial importance has become available which was not known <br />and could not tmvc been known at the time the Final EIR was certified; and <br /> <br />WIIEREAS, <br /> <br />thc City of Pleasanton has carefully reviewed and considered all of the inthrmation <br />presented at the public hearings with regard to the Project, and finds that the <br />environmental review has identified all significant environmental effects; and <br /> <br />WHEREAS, the City of Pleasanton has balanced the benefits of the Project agairkst its <br /> unavoidable environmental risks as set forth in the Final EIR. <br /> <br />NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Adopts the attached CEQA findings (Exhibit A) and the statement of overriding <br />considerations (Exhibit B)prepared for the Bemal Property Specific Plm~ and <br />prczoinng, annexation, PUD Plaxxs, Preannexation Development Agreement, <br />Growth Management Agreement, Affordable Housing Agrcemeut, and other <br />related matters. <br /> <br />Section 2: Approves the Bemal Property Specific Plan, dated August 18, 2000, attached as <br /> Exhibit C. <br /> <br /> <br />
